Ask for partial refund?

I bought a mobile phone on ebay that was was described as brandnew in the title and stated that it'd only been out of the box to take pics and was completely unused.

Received it this morning, and it has a heavily scratched screen protector (not removed to check underneath), has a few scratches to the casing and large deposits of pocket fluff in the usual places. Personally I'd say it's had about 6 months normal usage, but still in VGC. Either way I don't feel it's as described.

I've bought it as a temp phone with a view to either keeping as a spare or selling on once I get mine repaired, so brand new or VGC isn't a major issue, but I did pay a bit extra for as it was new. Would it be fair under the circumstances to ask for a partial refund, as I've seen on here that people ask 'trying it on'?

Item was £55, would expect around £10 as it'll cost me several pounds to send back.

    Partial refund requests can be contentious..it's agreeing a fair amount considering the item is mis-described. If you are happy to keep it but feel £10 is fair..put this to the seller. If he refuses and denies that it's used..all you can do is open a SNAD dispute in Paypal (presuming you paid this way)..you would then have to return it at your own expense but would more than likely receive your full payment (less the return postage). Make sure you take photo's of the scratches etc.

    As a seller I never (well almost) do partial refunds the buyer either wants the item or not. If a buyer comes back to me and asks for one immediately I get very suspicious about motives. I would contact the seller about your concerns and see what they come back with, A good seller will offer a refund on return including return postage (if it was there fault or misdescribed), but as paypal can't force them to do that (even if they are a business) you will not always get this

    That's my thinking. I'll win a SNAD dispute, but be down £7 on return postage for nothing. I'd have happily paid £40-45 for a used one, so as asking for the difference.
