Large ISP has set up a Recurring Payment on my credit card without my authorisation

and they have so far ignored my written requests that they cancel this. I have documentary proof (a copy of the contract, signed by both an officer of the ISP and myself) showing that I ticked the DD option, not the credit card recurring payment option.

What law can I throw at them? This must be unlawful. I am tearing my hair out. I have written to all the relevant officers at the ISP and got absolutely nothing back in writing, just two warm and fuzzy messages from a lowly accounts clerk relayed to me via my account manager and a vague offer to give me a credit for the payment taken.

I know that there is no point in cancelling the card, as they could just go on taking payment from the closed card, and the credit card provider would expect me to keep paying off the closed card.

Edited to add: this is for £182 per month!

    Well, I don't know about you but I like to be in control of my money. Also, a recurring payment on a credit card cannot be cancelled by either the credit card holder or the credit card provider. Only by the person/organisation using it to pay themselves, so no incentive there to cancel it.

    This was for a dedicated server which was then not delivered to specification and since then everything that could go wrong has gone wrong. I want to cancel the 12 month contract (there is a paragraph in the contract that allows this, at 30 days notice) but they are ignoring my formal cancellation notice as well.

  • Isnt it more likly that it was in the small print somewhere that you didnt bother to read and understand?
    When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.
  • Sorry, read your post wrong.

    Have you tried contacting them to get it changed? you may not need to throw a law at them! It might be an honest mistake.

    So name and shame the ISP ?
  • Well someone must have gave them your credit card details. Direct debit does not include your credit card details.

    I agree. The story doesn't make complete sense. They cannot just set a CPA up without you supplying the relevent card details.

    If they refuse to cancel and are contractually obliged to, then you can raise a dispute with the Card Provider as any further payments being fraudulent.

    Sorry, I should have mentioned also: I told my account manager over the telephone that the set up payment and the first month's subscription could be taken from my credit card and gave her the details to do this. I then followed up with an e-mail to her confirming what I had said and saying that for the rest of the year I wanted to be invoiced rather than pay by DD. But on the order form, which is the basis of my contract with the ISP, I elected to pay by DD but that is not what happened.

    No, I read terms and conditions before I accept them.
