the guys at my dept made redundancy through points system, it was made clear to us that people who had days off would be affected even if they were on long time sickness,
one employee who has worked for the compny for 12 years got ill and was on sicky for over a year,
guys in our company was made redundant but that person who was on sick note for a over was not touuched.
my question is should that person be redundant or not?

A firm has the right to make redundant anyone they want to provided they give them the correct redundancy money or notice.

Entirely depends on the points system.
It may be points for each event hence this one event, he may have a disability which cant be discriminated against. maybe even with sickness he is better0 -

Sick days can be taken into account. Just because he's had a lot of time off does not mean he should automatically be made redundant, just that he scores the minimum (or maximum) in that particular section of the matrix. He probably scored much better in all the other aspects. The scores will be looked at on the whole as a total.
Last in, first out, is no longer an appropriate method to use as it can come under age discrimination legislation, but length of service is acceptable to use in a tie break situation.
