Stolen Parcel delivery!- I am now liable

Just wondered if any one has any advice etc.

I ordered some items from next totalling £115 to be delivered on Tuesday.

Usually the courier leaves the parcel to the front of my flat which has its own covered access.

On returning home from work no parcel was to be found, i called Next and they have said that the parcel was delivered to the front of the house and that if it not there then they is nothing they can do as i agreed it!

So they are charging me for the order yet i have not received it.

I dont know what to do im at my wits end. Its so bizarre as this has never happened before and im flabbergasted.

Next have pretty much said that they think im pulling a fast one and they that are holding me liable for the cost of the order.

I have logged this with the police but its doubtfull they are going to find the parcel. its obviously one of theflat occupants as to access the fronts you need a key which only we have.

I just dont know what to do .

  • Is the parcel supposed to be signed for? If so then the delivery company will be responsible as they have not done what they are paid for. Dont panic, ring up the delivery company and ask them

    When they delivered it.
    Who signed for it.
    What they are going to do about it as it is their problem not yours.

    Ask your neighbours too, they may have left it with one of them and if they have a signature for someoen next door then get the cops in if they say they havent got it.

  • If you've lodged this theft with the police you should have some sort of log number for the incident, if not then phone them up and request it.

    Then contact next, and re-tell them what happened, and tell them you've told the police, and that you can provide a log number of your complaint, this should make them immediately more compliant with the situation.

    Most fakers will not bother making a police complaint, because it could come back on them, so the very fact that you have and can prove as such should help your case for a refund or a new order.

  • Well it is meant to be signed for as its a secured delivery but they are saying that i have asked for it be delivered there so they have done what is asked.

    unfortunately i have checked with my neighbours and they said they did see it but they didnt pick it up.
  • You might be worth ringing consumer direct to see what their viewpoint is. As you asked for the delivery to be made without the signature there might be something in Next's terms to say that if they do this then the risk is with you and I suppose if they can prove that the courier delivered (and you know this to be the case if another neighbour saw your parcel) then I don't know what rights you would have. Sorry not to be more helpful but do try consumer direct.

    I would definitely also involve the police as you know that someone who was inside your building on the delivery day has taken your parcel. Try looking on ebay too and see if anyone local is selling the same stuff that you ordered!

    How did the courier get it there if you need a key to access? The area is either secure or it's not?
