Help! Fake Nike shoes. Paid via PayPal.

Hi,

I bought some nike shoes from a guy who had an auction on ebay.com. The guy was from usa.

I tried to buy them directly off ebay.com but as he was not selling them outside usa i could not get through checkout.

Instead i bought them directly off the seller and paid through PayPal.

The shoes came and it turned out that they are fake! The very first time i wore them water was seeping past the seams and into the shoes! And we were only having a light shower!

The seller said he will refund me if i send them back with the box but the kids took care of the box as soon as i took out the shoes.

PayPal are not being very helpful at all.

What rights do i have?
What can i do?

    paypal offers buyer protection for all the items bought on the Ebay. i had an experience when i bought an item paid through paypal through EBAY but item never arrived. i asked the seller for proof of posting which he didn't send.
    i went through paypal protection scheme where money was refunded back from Paypal after i submitted evidences.

    problem is i didnt actually buy them off ebay. ebay would not let me buy them as it was listed for usa only so i ended up just sending him the money directly through paypal.
  • did you open a dispute console what Paypal prescribes? quite possible you might have already explored this...
    i realised that you bought from seller directly but you should alert EBAY, they can close down that seller account
    How do I open a dispute when I haven’t received my item or I’ve received an item which is not as described?

    Answer :
    You can open a dispute in the ‘Resolution Centre’ of your PayPal account within 45 days of payment in the event that:

    * You don’t receive the item
    * You receive an item but it is significantly different than the description on eBay

    By opening a dispute, you can communicate directly with your seller to work out a problem transaction.

    If you reach an agreement with the seller you can close the dispute. If you're still not happy with the result, you can escalate the dispute into a claim. PayPal will review the claim and decide on reimbursement.

    To file a dispute on a transaction sent through PayPal, follow these steps:

    1. Log into your PayPal account at
    2. Click on 'Resolution Centre' at the top of the page
    3. You will have the option of:
    * Clicking the ‘Dispute a Transaction’ button, or
    * Clicking the heading ‘Report a Problem’ and then clicking the ‘Report a Problem’ button
    4. On the ‘Report a Problem’ page choose ‘Item dispute’ then click ‘Continue’
    5. Click the 'Find transaction ID' button to display your transaction history
    6. Find the transaction you wish to dispute and click the ‘Transaction ID’
    7. Click 'Continue'
    8. Choose the reason you are opening this dispute
    9. Provide additional information then click ‘Continue’ to open your dispute


    Some points to note:

    * Generally buyers must wait at least seven days from the date of payment to escalate a dispute for an item not received
    * If you don’t resolve or escalate a dispute within 20 days it will be closed. When this deadline is approaching, we will remind you by email
    * A closed dispute cannot be reopened or escalated to a PayPal claim
    * Only one dispute may be opened for each PayPal payment

    thank for taking the time to help out techmanx.

    i went through the paypal escalated dispute and even spoke to them on the phone.

    they said basically im screwed eventhough the item was not as described.

    are they just fobbing me off or something? because the item is definately faulty and not as described.

    Don't waste time, get a chargeback done on your c card.

    You did use a credit card to fund paypal........ right???

    If you didn't then you're stuffed.

    Simple rule....which you need to remember for the rest of your life

    When buying stuff use a credit card.......repeat "When buying stuff use a credit card", or more simply


    NO CREDIT CARD, NO BUY

    Paypal has a lot more protection for items bought on ebay than bought outside as you have unfortunately found out to your cost. On ebay there is full paypal protection for both non received items and not as described items and in the case of fakes you would have bene able to get a full refund on proof of the shoes being fakes and you would not have had to return them.

    Off ebay your only protection with paypal is if goods do not arrive and the seller has funds available to refund you. There is no dispute possible for anything other than 'item not received'.

    As this was not an ebay sale ebay will not be interested, why should they be? You could try phoning paypal and working on them on the basis these items are fake, they might do something but I suspect not. You could always try reporting them to the US equaivalent of trading standards as well, that might not help you but it might help to get them shut down and help others from being scammed.

    i have been a very silly boy! :sad:

    i think i will try and report to nike or something. im thinking if i write a very nice letter to nike they might feel sorry for me and replace the shoes.

    And the moon is made out of cheese... first of all they'll be pi55ed that even though youo love their trainers you didnt buy them from them direct or a proper shop, but also that you were trying to buy them from the USA losing them the increase on uk prices too.

    they may just send the heavys round to chop off your feet :D

    i would have loved to buy them from the uk. problem is they dont sell them in the uk!!!!
