3. Do not mention you are recording him without his knowledge, as that will get you in trouble and you could faces charges.
Not entirely correct, you can tell him you are and would need his permission to play it to a third party (unlikely he would agree) or you can not say anything.
Whether it can be used as evidence by the police is another matter.
Can I record telephone conversations on my home phone?
Yes. The relevant law, RIPA, does not prohibit individuals from recording their own communications provided that the recording is for their own use. Recording or monitoring are only prohibited where some of the contents of the communication - which can be a phone conversation or an e-mail - are made available to a third party, ie someone who was neither the caller or sender nor the intended recipient of the original communication.
Do I have to let people know that I intend to record their telephone conversations with me?
No, provided you are not intending to make the contents of the communication available to a third party. If you are you will need the consent of the person you are recording.0 -
Thanks for the responses, I have spoken to him yesterday in the morning, and calmly explained him that i would go to police if i see him or his assitants in around my property and if he continues to make nuisance calls to my landline.
he then became abusive on the phone challenging that "he would come & see me ,etc "
but i did not put the phone down and explained why i do not want to pay him. he remarked that i am trying to correct my own mistake.
I had no phone calls since than but i am trying to avoid walking down alone after dark or letting my wife/children go alone. this has meant that i have to take few days off & work from home to settle the matter.
I agree that with the comments that a) builder being of specific race is not an issue b) his assistants i can only suspect could be ill legal or could be legal workers
I have written down the complaint for police and have taken those statement out.
I did record our telephonic conversation but did not have the courage to tell him.
I not planning to produce it before police at the first instance.
not sure how if i am right in thinking that the builder would probably keep a low profile for sometime and might actually assault or arrange some thing after sometime or am i being paranoid...?0 -
Fingers crossed you're just being paranoid. I know what a worry it is when you have a little 2 year old who relies on you. Good luck with it all. There's a storm coming, Mr Johnson. You and your friends better batten down the hatches, because when it hits, you're all gonna wonder how you ever thought you could live so large and leave so little for the rest of us.0

In addition to the police it is imperative you report him to your Local Council's Trading Standards department ! !0

Or you let him correct the work and then pay him for the work he has done. Easiest, quickest and most appropiate course of action and hope he doesnt report your racism.0

What racism? Describing someone as Asian is in no way racist!!
Unless of course you are a member of the PC brigade (similar to the ones that mean my son has to now sing "baa baa rainbow sheep" at nursery)0 -

Unless the OP made racial insults when speaking to the builder or the builder's friends then there is nothing for the builder to report.I'm not cynical I'm realistic
