Seller delaying completion date!!

We are first time buyers and thought our experience was progressing nicely. Offer accepted 7 weeks ago. Everything in place. We have signed our contract and they theirs. Buying house from a split marriage couple. She still lives in the property.
She is delaying/refusing to give a completion date.:mad:

Have you exchanged contracts, or are the signed contracts sitting with your respective solicitors awaiting exchange?
If you have actually exchanged contracts, I'd have thought a completion date should have been agreed and inserted into the contract before you exchanged. If you have exchanged, and there is a completion date in the contract, then she has to stick to that.
If you haven't exchanged, not sure there is too much you can do except say she needs to agree a completion date by X or you will pull out...
If you've exchanged but there is no completion date in the contract, complain to your solicitors!0 -
I would assume you have not exchanged contracts otherwise you would know your completion date.
I would ask your solicitors to find out why they are delaying the exchange/completion date and threaten pulling out if you not get a sufficient answer.
As it is a seperation you never know they could be on the verge of changing their minds / getting back together so I would push them by saying you will pull out. If they are serious about selling they won't want to lose you trust me!
Ultimately it is up to them if they decide to pull out if you have not exchanged. You would think your solicitor would be pushing for this as they want their money too!!0 -
we are awaiting for her to give us a move out date so that the completion date can be set. She is moving into rental, or so she says. Slightly cautious as we know she dosen't want to move and would prob be delighted if we pulled out.0

if you have actually exchanged contracts she has commited to sell to you, your solicitor should give you advice. if you havnt yet exchanged either of you can drop out and it could go on indefinitely0

we bought from a recently divorced couple, and from the very beginning were told it had to be a quick sale.
no less than five exchange dates came and went with various difficulties, none of our making. very stressful.
among other things, we found out one half was quibbling over £500. we asked our solicitor to kindly point out that very soon there would be no money to quibble over.
part of the divorce settlement was that the woman living in the property should have two weeks between exchange and completion, which meant somehow the solicitors could push it through.0 -
If I am acting for a buyer and I find out that the seller is divorcing I warn them there could be delays related to disagreements between the couple or the need to get a court order to rubber stamp an agreement before husband's solicitor will advise him to allow sale to proceed.
I tell my clients to try to investigate how far the couple have got in sorting things out and to threaten to pull out at an early stage if there is likely to be any delay because of arguments.RICHARD WEBSTER
