    Blimey, there is a commissioner's decision that states that if the case was already open, and the NRP had initially been contacted, then it doesn't matter if they don't receive notifications - even if sent to the wrong address. ONly in the initial applicaiton does that matter.

    This is what i have been contesting over the years with them .Not sending out notifications for initial period .Sending you different assesment amounts dated same day .Using figures out of thin air for my income .
    I will chase up the data protection prints so i get a clearer understanding .

    Ah, but they DID send you the initial decisions - in 1998. What this shows is that they didn't calculate it until then.

    I got a full brekdown of accounts and i called the helpfull guy up in accounts and asked why it took 2 1/2 years for them to notify me in Jun 1998 and all the system told him was over 13 weeks and he didn't have anymore info from that .Although the copy letter i have from the agency (not the original) has a wrong address on it

    Did you receive a maintenance enquiry form? If so, then you would have been expecting to hear from the CSA - that was the crux of the commissioner decision, and so could have chased them up at any time. From the date of the letters, it looks like they sat on it for 2 years before they even calculated it and you said that back in 1998 you got the letters - so if they are dated 1998 and you got them in 1998 then you got them as soon as they calculated it.

    After battling it out with them after they took me to court the first sight i got off the lettrs were copies i had asked for before i went to court .The copies i received were addressed to me but not at the address i was living it.At that time it was a constant battle on the phone with them as when i moved address i had assesments after that which had these £7000 arrears on them .

    OK, but you had received the Maintenance Enquiry Form? If so, then you will still have to pay the arrears as you were aware of CSA involvement and could have contacted them at any time to query the lack of communication from them. That is basically what the commissioner's decision stated.
