    Check it out, but I suspect for technical reasons, your choices are to insure or to claim adverse possession. If you insure and then go for adverse possession, you will be poking the sleeping dogs you are trying to insure against.

    Don't let your desire for this property push you too hard. Only accept what you would be prepared to sell on. Your sellers are in the best position to resolve this. If you buy and they have not resolved it, you are most likely in a worse position when it comes to reselling, even if you get a declaration off them - possibly you still lose the land, otherwise if you have not gained adverse possession yourself, your buyers are going to look at a declaration from their sellers seller so many years ago covering 25 years of use and have doubts as to why this was not sorted all those years ago. This will not look good!
    I think we will put in an offer based on the land they own. I will also ask solicitor about a insurance policy to cover us if we make the adverse possession claim
    Put in 2 offers, 1 with and 1 without. Make it attractive to them to get the possession sorted.
