If its a private car park they can go take a jump.
If they were to take you to court and lost then no more tickets could be issued. I would imagine they bank on a percentage of people paying.0 -
OK, I am off to Uni now. But Thanks, I will do some more research tomorrow, to be sure. But if this is not valid until it has been to court, then they can take me to court.

Is it not worth having a word with Lidl & ask them to LEAN on the parking company if it is Lidl's land? Surely they would want your goodwill towards their company so that you return & spend more money in their store. After all, you did do a reasonable shop in their store. They could argue that you were just using their parking spaces if you just went in for a packet of sweets etc, so I guess it could depend on the size of your shopping bill. You could suggest that if they won't budge then you'll contact your local newspaper & see how they like the resulting publicity.Donedoingdebt Lightbulb moment January 2000. I would contact Lidle and make your argument with Lidle, it's unlikely the carpark management company give a t*** what you think about their penalty notice. Lidle on the other hand do care about their reputation. They must have agreed the contract and agreed the levels and situations where fines are made. If you can get Lidle on your side, possibly, you have a chance. From the looks of the website above though, what they are doing is perfectly legal. As long as they tell you the terms and conditions of parking, they can do and charge what ever they like.0 -

I spoke to a lovely person at Customer Services, who (in his very nice Scottish accent .....
) understood that this was a misunderstanding and suggested that I write an appeal.
The store did open at 9am (not 8 as I was told by hubby)
So, Fingers crossed!

hi - yes write an appeal - anychance you want to name and shame the car parking company?
even if it is a private carpark then they would be well within their rights to fine/take you to court PROVIDING they clearly signpost the parking conditions.
I succesfully appealed a parking ticket agains weymouth council last year though for slightly different reasons. I parked (and paid £6 for a 24hour pass) while i went fishing - unlike the tickets where I live though, the ones supplied in this acr park were not adhesive and the ticket fell down behind my dashboard (its still there now) and I was fined for not displaying a valid ticket.
I wrote to the council explaining that I was not going to pay the fine as I held them responsible for not supplying adhesive tickets. I specified he machine, time and price I paid for the ticket. I also said that I understood that they would want evidence that I had paid for the ticket before they would revoke the fine. And that if the information I had supplied was not good enough they were more than welcome to came and take my dashboard out at their expense to retrieve the ticket. - they sent me a letter saying they were going to take no further action


but yes appeal to the car park company, explain that you may have arrived @ 8:38 but as the shop didnt open until 9 you didnt leave your car, and that you finished shopping and returned to your car at 10:33. - were you aware of the 1.5 hour limit, if not say so - and say they should signpost it better. it may also be worthwhile finding out how they define "to park" whether they are only interested in the amount of time you spend within their barriers or from when you leave the car. - technicality I know but murder cases have been thrown out for lessIn dreams there are no impossibilities0 -
I had the same sort of thing happen to me but it was at Tescos. They sent me a letter saying they knew I'd parked for more than the allowed amount of time but since it was a first offence they wouldn't enforce the fine. I guess they sent the letter so I knew they were actually watching and I'd learn a lesson. Worked out well for both me and Tesco as I learnt my lesson but tesco kept their goodwill and I still shop there, but within the time! Shame Lidl don't have the same policy. (ps Lidl's fine is twice as much as Tesco but with a shorter allowed time - bit unfair!)What did I do at work before I discovered MSE?!
