Hmmmm I bet you have a great case and are not just trying to screw them over on a technicality for every undeserved penny!
That is out of order. You don't even know the situation the OP is in.

Don't hold your breath,My claim was put in and accepted Oct 2008,my tribunal was scheduled for June 16th 2009,postponed at the other sides request on June 7th,still haven't got a date as yet but they have said maybe Dec.Methinks they are rather busy at the moment.
  • Sadly the number of tribunals has increased and therefore there is pressure on the ETs.
You were, i hate to say, fortunate that you did not have to turn up before they postponed because tribunals have been known to schedule a number of cases on the same day and you can hang around waiting for the other case to complete only to find you are rescheduled. You will normally be given priority on any new cases coming into the system, although this will not help you at the present.
You are in the inenviable position of needing resolution and, unfortunately, some companies rely on you to pull out and accept lower payments even when you have a very strong case, because of the financial situation. If you can, hang on in there as even if you agree with ACAS on a settlement some unscrupulous companies will stretch out every possible angle to prevent payment.
  • phew got a new date just about a month to wait in the post today. I would like to add the only reason I couldn't wait was for my wives health and I was very shocked at how late it was cancelled.
