    The biggest argument you have to face first of all if you are going to go down the SOGA route is that Staples is a Business only seller and the below is taken from their T's and C's
    By placing an order you warrant that you are a business user

    As you in effect advised that it was a business to business transaction when buying the item, Consumer laws will not apply. Therefore the only thing you have to rely on is the manufacturers guarantee.

    Are you sure, I had a laptop replaced by staples under SOGA in August, it was 18 months old, I was also given gift vouchers for the inconvienence.

  • Can I just add, I've heard back from John Lewis in record time after complaining about my 13 month old HP laptop and asking for a replacement under the terms of the Sale of Goods Act - about 3 days after e-mailing them I had a phone call telling me I could choose any laptop of equivalent price from their website as a replacement. Good service - I will definitely use JL again!
  • I bought my laptop 18 months ago with an extended 3 year warranty.
    I've had nothing but trouble with overheating problems (Its a fujitsu, so yeah, its rubbish!)
    I sent it away recently and they reckon its over heating because i use it on my lap?? stupid or what??
    Anyway, they reckon that because of this, it is my fault and they say they will charge me £350 to fix it, or £110 to return it??
    Is this justifiable, and more to the point, is this actually legal??

    My reply went something like 'well yeah, if it wasn't to be used on a lap, then being named laptop is a bit misleading'

    The man was very rude, and spoke to me as if i was an idiot. The truth is, i have a degree in I.T and know what the problem is and how to fix it.. but it would cost me about £100 and the machine is under warranty.

    No. They are not called "laptops" and are instead now referred to as "notebooks" by the manufacturers for this very reason.

    I'd hope someone "with a degree in IT" (IT =/= hardware mind...) would understand if you block up all the vents on a laptop, bad things will happen.
