If it actually goes to court then I'd go if it was me just to make sure they get it right! I went to court when they repo'd my car as they wouldn't take it unless I signed their forms stating I'd be liable for the shortfall.

Thats why they had to take me to court; because I'd already paid 2/3 the contract said they couldn't take it without my permission or a court order. I couldn't give my permission because of the liability. If they had taken it without consent or court order they would have had to pay me back every penny I had paid to date.
If your wife is going BR anyway and can't afford the car payment then it will get repo'd by the court order so save yourself the ordeal (unless of course you can get money back like my contract).

I bought my mum straighteners early thios year for her birthday. They broke in less than a month. I then started to comunicate with the company i bought them from, which started a 4 month war for them to take them back and replace them. So sent via Royal Mail back to China. Well the guy in the post office even tho i asked didnt send them recorded mail, just air mail.
So the company denied getting them. I'm done fighting so i ended up trying to get royal mails help.
Today i get a check for £39 half the cost of the straighteners.
So yet again i end up being out of pocket
little thing i know, but still its got my back upIn for a penny in for a pound :j0 -
