I can see both sides to this sorry tale. In my opinion the outcome will depend on whether or not procedure was followed. The employment tribunal will decide that! It's very important for the employee to be totally honest and equally important for the employer to follow the correct procedure..Any thing said by other employees is hearsay until signed and then it becomes a statement. The tribunal will come to the correct decision and if the employee is open and frank it will help him come to terms with that decision if it goes against him..
We all know the risks we take when we do something wrong and employers are sometimes in very difficult positions when it comes to running a business.. The employee has nothing to lose now and must take it as far as he can. I always work on the assumption that if you fire enough arrows in the air one of them may land in the right place....

I work for a large company, so this may not apply for smaller ones but...IN our company there is a cooling off period where the resignation letter can be withdrawn if the signee decides (for whatever reason) that the resignation letter was signed under duress or by error of judgement.

Hope this guy nails the employer to the wall
