Debt Relief Order Question
My mum is currently having all her creditors handled by the Citizens Advice Bureau. However, she is very puzzled as to why the CAB have not automatically put her through to court for a Debt Relief Order, which the CAB officer suggested when my mum first made an appointment with CAB to get her bills sorted out. My mum has been waiting for weeks to hear back from the CAB, so when she finally got the letter from them over the weekend, she was very surprised to see that they haven't put her forward for the DRO, but have just written to all her creditors offering a £1.00 per month.
When my mum first went to see the CAB back in August, their consultant said that as my mum was a pensioner and had no other income coming in apart from my keep, she would have no problem getting this "mini bankruptcy" (cost £90). Therefore, my mum assumed that the CAB consultant was putting her forward for the DRO.
Will my mum have to apply to the court herself for the DRO, or should the CAB have done that for her in the first place? My mum would much prefer all her bills be written off completely, so that's why she wants the DRO.

No you can only do this through an intermeadiary (sp?)
How much is her debt for? Does she have any assets worth more than £300 or car worth more than £1k. Is her pension government or private?BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0 -
Hi. Thanks for your advice. My mum's pension is a widow's pension (government). She has no assets. As I said, she DID consult the Citizens Advice Bureau, and the consultant there gave the impression that she was automatically putting the DRO through for my mum, although she did say she would need to find the £90 court fee. Mum owes around £6000 in total debt (Barclayloan, LPF etc.).

Hi,
I think you need to contact your CAB and remind them that your mum would like a DRO. It would seem that she fits the criteria. As Tiger says, there is an issue around pensions, but not in this case as the pension is already in payment.
It shouldnt be difficult to get the disposable income down to £50 pm considering the various allowances.
