Hi, I'm after a bit of advice please. i dont usually use comet but ha d gift voucher so had no choice. I bought a brand new lap top on 2-11-09 (exactly 14 days ago).
Yesterday it developed a problem where it appears the left mouse key is constantly clicking making it impossible to use as when you move the cursor over something it automaticcaly and repeatedly opens it.
I uninstalled and re installed the drivers. I then reset the lap top to its original factory state. Still same effect...... Today i took it back to comet, they looked at it and agreed that it could not be used due to the fault. However when i asked for a replacement or refund they said they had to speak to the manufacturer. An hour later and and lots of tests and the manufacturer would not confirm for them over the phone that it was a hardware fault. They then said that due to this they could not get an "rma" number which they need on there system to give me a refund and they would have to fax the manufacturer for one but this could take days and is not guarenteed that they will get one.
They basically said that as they were not sure that they would get refunded from the manfacturer they were not prepared to give me a refund, even though the lap top was obviously broken, not fit for purpose and only 14 days old.
As you can imagine the conversation went on untill i felt i had banged my head against the wall for far too long. They said they would look into it and get back to me...... i left with my receipt, lap top and head ache an hour and a half of my own time down.
Anybody know what my rights are please?? Thank you.

Who is the manufacturer, out of interest?Squirrel! If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.

Your rights are against the retailer, not the manufacturer, in all cases.
It doesn't matter a toss to you whether or not they can get an RMA. You don't need it. You just need a new laptop. And they should give you one.0 -
Wait to see if they get an RMA first, annoying though it may be.Squirrel! If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.
