Is anyone actually receiving refunds while the banks are at court or is everything on hold waiting for a ruling?

Financial hardship cases are getting refunds albeit partial refunds. Most cases are on hold currently but that should not stop anyone starting the process of reclaiming the charges today.

How would one qualify or prove "financial hardship" in order to receive at least a partial refund?

Still using the account, still incurring charges, have an issue that caused the charges to start ie loss of employment, separation from partner, etc, etc,. Furthermore, the charges would take money out of your budget to pay priority debt arrears(mortgage or rent, council tax, utilities).
It would have to be household income and expenditure being insufficient to cover essential outgoings(because of the charges). Each bank does appear to have its own criteria for dealing with this.
