How can they refuse to sell me a car?

I had, this morning signed up to buy a used car from a reputable dealer. Everything was going well, i got the price i wanted for my part exchange and the cash difference was agreed. I didn't want any optional extras at all then the sales adviser told me that his manager would not allow the car to be sold without me forking out £25 a month for 24 months for a warranty for the car. We both (hubby and me) decided that we did not want the warranty and when i rang to tell the garage they told me that they could not sell me the car. Is this legal or are they trying to pull the wool?

They can choose not to sell the car to you, for any reason other than for reasons such as race, sex, sexual orientation, religion and disability."You were only supposed to blow the bl**dy doors off!!"0

I'm not clear if you have you have a signed contract or not.
If you have not signed a contract, as maninthestreet states they do not have to sell you a car.
If you and they have already signed a contract, then in effect they are in breach of contrract (depending upon the wording) and you can take them to court for you losses.

Have you actually agreed a contract?
If you have, did the terms of that contract include the warranty? (since you appear to have phoned them to say you decided you didn't want the warranty now)"Now to trolling as a concept. .... Have you got the small print for the warranty?
Is there a cooling off period so you can do-over the dealer afterwards and the warranty company will withhold/claim back the incentive/bonus.I beep for Robins - Beep Beep

Yes i signed a contract we even arranged the date and time to pick the car up I also paid a £100 deposit. I think they made a !!!! up on the price and are trying to claw some of this money back, or am i just cynical?0

dubious. why would a reputable dealer charge for a warranty, they are free on all the cars ive bought and my friends have bought.Target Savings by end 2009: 20,000
current savings: 20,500 (target hit yippee!)
Debts: 8000 (student loan so doesnt count)
new target savings by Feb 2010: 30,0000 -

So the contract doesn't have anything in it about you having to also have the warranty?
If not, they would be in breach of contract if they fail to sell you the car at the contract price.
So what made you ring the garage to tell them you didn't want something that wasn't in the contract in the first instance?

In that case if they do not now sell you the car at the agreed terms they are in Breach of Contract.
In my view you have two options:-
1) Demand they complete at the agreed conditions - you may need to send them a letter to that effect
2) Get your deposit back and walk away.
Personally I would not trust a company as incompetent as this, and dependent on how good a deal this is, would be tempted to walk.
Either way, please name and shame this company once you have either got your money back or the car!

I have just read through the contract there is a separate one for the warranty which i also signed, its the old classic, thought i was signing paperwork about my part ex. but have looked through the warranty and there is a 14 cooling off period so I could set it up then cancel it is the salesman that will lose his bonus if we don't keep it for 3 months. The dealer is Drive Vauxhall in Redcar --shocking.0
