hello, quick question...
my son was born august 09, exhusband left when 16wks pregnent.
when he left he was earning 30k... 1day before baby was born he left that job to go back to uni.
because of this he hsnt paid child support or even half the mortgage (joint names)
as a result im on income support (made redundant in july) and cant afford all the bills and all the mortgage.
a few people have suggested he'll have to pay child support back at the level he was earning before he quit his job, when he does eventually start working again.
any truth in this? i believe i'll have to apply for csa through jobcentre as i;m on income support...

Have you a case open with the CSA, the assessment only starts from when the CSA case is opened.
He will likely be assessed as zero payment whilst he is a student. When he does start working he will be liable to pay 15% of his net income..so if he again earns 30k then it will be the same, if it is a different salary then it will be based on that salary. (If you are still receiving IS then you will benefit £20 per week from this and lose the excess from your IS....eg if he pays £50 per week then you lose £30 from your IS)

if he has gone back to uni then he will not be liable to pay child support.
they cany legally backdate it as his circumstances are already laid out.
when he does return to the workplace, he will be liable for 15% of his net income.NEVER ARGUE WITH AN IDIOT. THEY'LL DRAG YOU DOWN TO THEIR LEVEL AND BEAT YOU WITH EXPERIENCE.

As has already been said, if you have no case open already with the CSA then there will be no backdating of anything before that date.
He wasn't liable for child support through the CSA before baby was born.
Have you seen if you are liable to have your interest payments on your mortgage paid through Income Support, depending on how long you've been on it?
You also do not have to go through the CSA anymore because you are on Income Support, They changed the rules last October. It is now up to you to notify the benefits people if you receive child support. You can claim Income Support and have a private agreement with the father for child support and keep up to £20 a week. Any more will affect your Income Support payments.
As he is a student, he would probably be asked to pay £5 a week child support. Have you tried speaking to him yourself with regards to child support?August GC 10th - 10th : £200 / £70.61

There is another way that you could look at this....once he has finished uni he should then be earning a decent living and your son will benefit better financially.
In the meantime can you not talk to your ex and ask him how he proposes to help you out financially?? Most students take on part-time work so maybe he could consider this and give you £20 a week towards your son while your on benefits.0 -

Maybe you should read fitz's other postings....he's played the game very well i'm afraid.
Yes there are 2 sides but her ex has been very unreasonable and selfish, hopefully in the future when he is earning he will help towards the costs of having children.
