Wedding Dress Agony! Please help!

Hi all, desperately looking for help here really. We're trying to get Tesco to refund a disputed purchase and they are refusing.

A few months ago, before our wedding, my wife purchased a wedding dress from a high street store (paying up front by Tesco cerdit card)

At the time the store said they could modify the dress to a certain style that my wife required.

About 3 weeks before the wedding the store produced the dress for a fitting and it was a mess. They then said that the dress could not in fact be modified to the style she wanted.

You can imagine the confusion, panic anger and distress this caused! We ended up getting her a dress from another store, and we have never picked up the original dress.

The dress shop have been shocking to deal with and we get a different story every time. To cut a long story short they are refusing to offer any form of refund (full or partial) and are basically trying to ignore us hoping we will go away. (They are a 'one-off' purchase type of place so I guess returns aren't their bag!)

We have tried to claim the money back from Tesco as it was paid for on a tesco credit card and as far as we're concerned we did not recieve the product that was advertised and are not accepting what they have offered.

Tesco are refusing on what I think may be a technicality. They are saying that the invoice we have does not mention the modifications so therefore there is no evidence that these have been agreed with the store. So they won't refund us. The ironic thing is the store are not disputing that they have modified the dress.

Our reciept states the price of the dress which has been topped up with the amount of the modifications.

I feel like we ar being fobbed off by the CC company and we are being flat out ignored by the vendor. We are down £1000 and don't really know where to turn! any advice would be hugely appreciated.

  • Tesco are correct - you need to prove the route cause of the dispute, i.e. the order should detail what you were looking to purchase otherwise its your word against the store's. Difficult I know and not what you were wanting to hear.

    I agree that I don't think this is something that cna be dealt with simply by a credit card claim. You may need to take this to small claims independently but you'll need to make sure you can evidence your claim.

    Small claims court to progress this one.
  • Yes it looks like we'll have to go through small claims court. I guess I should get swotting up on that.
