Professional Negligence

Hi all,
Can anyone help or offer advice please. I've already put a thread on regarding a retrospective build over agreement from welsh water and not getting one granted it has mean't that i have to take down my conservatory. :mad: This means i will lose the house i'm going for and lost my sale. I have lost the equity in my house as well.
I bought the house in Nov 2003 and when i purchased it my solicitors never made me aware of any adopted sewers running through the rear of my property. No drainage searches were done by them at all.
Do i have a caseto sue them for professional negligence as i have lost such a large amount of money and would never have bought the property in the first place ifi knew about the sewers.

did drainage searches form part of their T&Cs which presumably they sent you when you first applied to be their client

Found a conveyancing site with lots of (seemingly) good info.
Link refers to drainage searches - not clear to me whether a search has to be carried out but at least it's somewhere to start.

Why didn't the conservatory company find out that there was a sewer under the proposed conservatory before they put it up? Hasn't it got any foundations at all?RICHARD WEBSTER
As a retired conveyancing solicitor I believe the information given in the post to be useful assuming any properties concerned are in England/Wales but I accept no liability for it.0 -
these searches were not (unlike now with the introduction of HIPs) seen as best practice in 2003. Water companies would have you believe they were, but the majority of lawyers used copy water bills as simple evidece of actual connection to mains water and drainage.
here you have a situation where everything was fine in 2003, but by your own actions, you have caused your loss. You built over a mains.
I would agree, why did the builder not assess this. Maybe they thought they were private pipes, but even that could cause access issues.
Did you not have a survey when you bought, as again they usually flag the drains up.
I think it is the conservatory company you should be looking at, as there is only so much info that lawyers get given on a purchase to relay back to you, and they charge the least because so many people want that side done dirt cheap.My posts are just my opinions and are not offered as legal advice - though I consider them darn fine opinions none the less.:cool2:
