Any thoughts...its about my car

Evening everyone.

I have been reading all the car questions I can find, but I cant find owt that really gels with my situation, so I wonder if anyone has any ideas.

When I movedto my current address in april 06 my car had to be towed here as it had broken down months previously and I didn't have funds to get it fixed, new brakes, new windscreen, filters? tyres??

It has remained on my drive ever since. Its a bog standard punto 01 reg. Which is now covered in moss, and weeds.

When I moved in it took several months for my Housing benefits to come through, so I sold the car to my housemate to cover my portion of the rent. £1000 for 3 months. He took the green ticket thing, yet never sent it off. I had in the meantime SORN (ed) the car, but in my name. I guess that means that the car is still mine, because I can't prove I sold it?

My housemate is mad about it, but is willing to let it pass as doesn't want to stress me out about trying to hide it from the OR. I have also resigned myself that they will take it.

I have looked on auto trader and taxed and tested similars with a much lower mileage are about £700 so I cant imagine mine is worth anymore that £400 with the work that needs doing and its been parked up for nearly 4 years?

I am working with CAB, but haven't got to this yet, any ideas, I want to be 100% honest

Cheers guys

    Hi

If the OR did decide to take it (doubtful-under £1k) then your housemate could buy from OR.

He should have sent the form off!
  • Hi Kerrypn, mmmmn... nevermind hey?

I can't afford to keep a car anyway, but I would be very sad to see it go. Just have to wait and see, its all I have, my only asset - well, its not even mine, but you catch my drift

    thanks

If the car is not in working order the OR WILL take it as it is more a liability issue than cost issue.

  • Thanks fiveyearplan, that is interesting.

I'm in complete agreement with FYP, you've gone without the car for the last 3 years, so it's obvious you don't need it, it has some monetary value, therefore the OR will take it.

As for the OR not taking it because it's under £1k, this is not the case, if a car is not made exempt due to needing it for work, if you are a carer for relatives etc., the OR will take it no matter the value.

Apologies, I was under the impression that assets under 1k were of no interest to the OR as I was advised this by debtline before I filed.

Best of luck with everything :)

That is generally true, however a special case is made for motor vehicles as they carry certain liabilities so the OR must deal with them in some way

  • Thanks very much peachyprice and debtinfo. Makes sense even tho it is slightly upsetting. Would the option still exisit for housemate to purchase car back from OR if he wanted to?

I don't get the part when you say your friend was mad about it but let it pass?

    Unless I'm being silly here?:D
