Urgent advice needed! - Please help!

    You have already had loads of brill advice but I just thought I would say there is a thread called fieldcall on page 2 that has some excellent advice on preventing home visits.

    Just about every other company though. My original debts were with Cap1, Natwest, Barclays & Barclaycard. Barclays was 3 accounts. Oh and Chelsea for about £30,000

    They have been with a host of DCA's, some of whom i have got rid of by asking for a CCA.

    I have been saving for BR for nearly 10 months ( 2 of us) during this time i have gone from being worried about DCA's to not caring to having fun with them.

    Once you lose the fear of debt its easy.

    Hi Swamp, we actually had someone call at the house yesterday from Fieldcall, not in at the time so did not speak to them. They were representing EGG, anyway they left a letter telling me to contact them within 24 hours to arrange an appointment, mobile number by the way. This has unnerved my wife, so what I have done is sent an email with the template letter that Fermi so kindly posted for me, telling them to only contact me in writing and not to call at my house. Our Br date is a couple of days after yours, if anyone else turns up I will just tell them I am going BR and to leave my premises.
    Here is acopy of the letter.

    Dear xxxx

    Account Ref xxxx

    Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me by telephone over the past few weeks/months and these have been duly logged by time and date.

    Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.

    There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

    I just spoke to them and I had misunderstood that they were phone calling the house not calling at the house which is a big relief.

    Despite pushing for payment I insisted I was not prepared to discuss it till I had been to see CAB as I had other debts and they have put it on hold for ten days.
