Quick WTC Question

Asking on behalf of a friend of mine.

29 years old single male, working 30 hours a week, not receiving any benefits.

Has a take home before tax of £146 p/w.

He works 6am til 11am 6 days a week which is 30 hours but he has a half hour break each day so technically he is only working 27 hours, despite the fact he isnt allowed to leave the premises on his break.

Is he entitled to claim WTC would his breaks be included in his working hours?

  • If his breaks are paid he could claim WTC but if not he cannot claim to work 30 hours p/w.

    He may be asked for evidence at any time during his claim to prove he works 30 hours p/w and if his payslips dont show 30 hours his claim would be ineligible and any money received would be an overpayment.

    Does he get paid for his breaks? £146 over 30 hours works out at £4.87 an hour, is that not way below the minimum??

    hmm you have got me thinking now i hadnt looked into it that much! :o

    Even 27 hours works out at £5.40. Just looked it up and the minimum for over 21s is £5.80
  • Make sure if he does claim, to declare his 'top line' (gross pay).

    The gross pay must be declared and not his take hime pay.

    The income you have stated is likely after deductions which is why it seems to be below NMW.

    You're not taking tax and NI into account. 27 hours per week at min wage of £5.80 results in a take home wage of £145.05

    OP said the figure was before tax so I was just going by what she said

    He said take home before tax, which is a bit contradictory.
