Problems getting refund from asda

I bought an xbox 360 game yesterday from ASDA(barrow in furness branch) as a gift for my brother's birthday which is coming up soon only to fing out that my sister had bought him the same game from the same shop(as its cheaper there!) so i said i would take my copy back, when i got to the store i explained the situation and was told they could only offer me a like for like exchange??? i told them that was no good as i don't have an xbox i have a ps3, which i also bought a game for and was on the same receipt. so i walked out of the store rather p##### off to be honest and i would love to know if they can do this to me as it will leave me with a game that cant be used (well not by me) and my sister would get the same result if she took her copy back!! am i not entitled to get my money back by law????:confused:

    Quick answer no.

    Surprised though that you didn't get a credit note. I would be going back and speaking to the manager and/or call head office if no joy.

    Shops do this in addition to your statutory rights.. they don't have to do any sort of exchange/refund if you changed your mind/bought the wrong product.

    I'm surprised that's Asda's policy though..

    Basically most retailers do this as they suspect people copy the games and swop them.

    I was assuming OP had returned a still wrapped copy.

    Me too, as it was a present for someone else.
    Is anybody daft enough to even try to take a game etc back unwrapped.
    make the most of it, we are only here for the weekend.
    and we will never, ever return.

    That would be useful to know - OP, was the game opened?

    If it is, take it to somewhere like Game. If it's a fairly recent (or new title), they often have offers where they'll give you the newest titles for £10 or so if you trade in, and as Asda often have cheaper games, you may get almost as much as you paid for it.

  • I recently purchased a wii game from Tesco, the game was faulty (and rubbish) so I took it back to Tesco who replaced it like for like but wouldn't refund or swop it.:mad: So I was then a little bit naughty and took the new shrink wrapped game back to Asda and got it swopped for a PS3 game:D There was no problems swopping it as Asda but the game I then purchased wasn't shrink wrapped, in my local store only empty cases are on display, the disks are kept behind the counter, so any game that need to be returned even if unused wouldn't be shrink wrapped:confused:

    If I was the op I'd try again another day, hopefully you'll get someone more reasonable.

    How did you get Asda to swap a game you bought at Tesco? You wouldn't have a receipt.

    I was bought a DVD for my birthday by my brother, which I already had! It was still wrapped and had the receipt and I exchanged it for something else, no problems.

    Unless there's something like group fraud targeting ASDA at the moment i'd go back and query it.

    Legally they don't have to give you a refund/exchange unless it's faulty, however if they are advertising that you can return it and that it's not excluded (like Argos and items marked exempt from 30 day moneyback guarantee) and if you're item's still in perfect condition and fully shrink wrapped then they may actually have to refund/exchange it because they've advertised that you can.

    If worst comes to worst ring/write to Head Office, you'll have to Google it for the details, I know it's in Leeds!

    To qualify for a refund, products must be returned unopened and sealed. Music, film and games software products are covered by our 28 day ‘Changed Your Mind’ promise but are limited to one exchange only. Faulty products are returnable within 28 days of purchase and will only be swapped like for like, i.e. for the same product only.
    A receipt or other proof of purchase is required when returning these products, without it returns will not be accepted


    There return policy on games you can swap it for something else but not get a refund.

    Ps if you read the bottom of any of these policy docs it will allways state we reserve the right to refuse so if they wish they may refuse a refund.
