Airline Baggage Damage

Advice needed please! During a recent flight the baggage handlers broke the frame of my pram. I requested a quote for repair from the retailer and was told for safety reason it would not repair and that i would need to purchase a new chassis. A replacement pram would have cost £700 but I put in a claim for £235 for the cost of the new part. The airline have sent a cheque for half the amount saying they are liable for indemnity not replacement. I am arguing that indemnity does count here as i am not asking for a replacement pram but repair of the damage. They are refusing to accept this but I am refusing to accept that i should be £117.50 out of pocket for their negligence and incompetant handling of my luggage. Does anyone kow what my rights are here and where i should pursue them next - small claims court? this has been ongoing for 6 weeks now and i am going to have to order the new chassis - should i cash their cheque for half the amount now and use it towards the cost of the chassis or will that be classed as accepting their offer? Any help appreciated!

anyways, dont cash the cheque, go to consumer direct to get advice, create a final letter before action and post it to them recorded, then if they dont pay go to court. simples.Back by no demand whatsoever.0 -
thanks - will give it a try. in the mean time i'll have to order the chassis and be even more out of pocket until they pay up!0
