legal car owner
Hi can anyone help me in may 09 my husband and i brought a new car on the scrappage deal. i put my car in and recieved 2000. off the new one. the paperwork was in my name although hubby got a bank loan, i sighned the log book from my name to his after he demanded it was in his name. in july he left me and has since taken the car, we have a 6yr old. hes keeping the car and going to give me 1000. at some point.
1)am i classed as the legal owner as the sale document names me as purchaser.
2)does he only have to pay me 1000.

If your name is on the bill of sale then you are the legal owner. The registered keeper of the car is not the same as the legal owner of the car. However if your husband took out the loan and makes the repayments then I think it is fair to say that it is his car.
Is the £1000 to cover the £2000 discount he got using your car in the scrappage scheme? If so what was the approximate value of your old car? If it was less than £1000 then accept the money and be happy. If it was more than £1000 then all you can do is ask him for more but you'd probably have to allow for any further depreciation?0 -

I'm no expert on this,
But aren't married couples treated as a single legal entity for most purposes. I.e. You both own it / are liable for the loan.
I would imagine this would be covered in divorce proceedings, unless you came to a mutual agreement beforehand.
I can see your husbands point and to kind of agree with it.
The old car which presumably you purchased together was worth £2000. He is giving you half that value.
The new car is paid for via a loan in his name, i.e. you haven't contributed anything towards it. Therefore assuming he is going to carrying on paying for it belongs to him.
If you weren't married i believe the car would belong to him.0
