Can employer take out overpayment of salary in last wage??

Hi

My partner was made redundant in July and had his redundancy pay etc. The company have kept him on on a temporary contract.

  • Unless there is a specific clause allowing them to deduct then no. The error was theirs i assume and that is why there was an agreement to repayment of £40 per month. They cannot arbitrarily deduct money. The problem is what he can do about it.
  • She is wrong. Unfortunately, as I said, it is what can she do about it? If they deduct the money what can he claim? They deducted money that is theirs. Although he could potentially claim any hardship costs as a result.
