Warrantee on phone

Earlier this year I got a new HTC touch diamond when I renewed my orange contract and as I know now the battery life on these things is shockingly bad. So anyway after 2 months of putting up with it, I complained to orange and they sent out and nice new shiny phone :j (i only wanted the battery) anyway it seems that I am again having the same issue with the battery not holding its charge so i rang orange to see if there was anything that they would be able to do.:mad:
I was told that on my original phone i was given a 6 month warrantee which was how i got a new one when i rang the first time, i was then told on this second phone I was only given a 90 day warrantee is this a standard thing to do?
If I can help it i would like to not have to pay for a new battery but it seems that I will, unless any of you ppl on ere knows if the above isn’t okay. :rolleyes:

There's no legal obligation for the manufacturer to provide any warranty on an item. But, under the Sale of Goods Act, the retailer is liable for any inherently faulty goods (i.e. down to poor manufacturing or bad components, etc). If it's less than six months since you got the phone, it's down to the retailer (I'm presuming you got it direct from Orange) to prove that the problem is not inherent (e.g. you have misused the battery by, say, only charging it to 20% full each time....not likely, eh?). After 6 months from purchase, the onus is on you to prove that the problem is caused by poor manufacturing - you can do this by getting an independent report by a professional to detail the problem is a manufacturing issue and the battery could reasonably be expected to last longer.
Batteries in phones do have a limited life, and by their very nature are charged and discharged frequently, so proving this would be difficult, but not impossible.Squirrel!If I tell you who I work for, I'm not allowed to help you.
