Loan with HFC bank and default charges

Hi
I took out a loan with HFC bank a long time ago, I was successful in reclaiming the PPI and got that back last year. I was very bad with money at the time and accrued quite a lot of charges in late payment fees, bounced direct debit charges, that kind of thing - as this was a loan, can I reclaim these charges?

Hi again
I sent my letter to HFC Bank and they replied back to me, saying they couldn't refund any money because "the loan was opened on 1.6.01 and closed 12.07.03. In accordance with the Data Protection Act (1998) abd Proceeds of Crime Act, HFC Bank only requires retaining of account information and documentation for a period of 6 years after the closing of the account., Therefore we will not be able to continue into any investigation regarding this account"
They have also stated that I can refer this to the FOS if I am not satisfied. Would you suggest I go ahead with this, or should I let this one go?

Apologies and have responded to the PM(usually respond to them before I look at the threads). There is no time limit under the Data Protection Act 1998. My understanding is that documentation should be kept for 6 tax years after the account is closed which means that they should still have the documentation. I would ask for proof that they have destroyed the data.0
