hbos replied to my 2nd letter .....

hi all quick update

i just got a letter off the bank saying that they are unable to to anything with this until the test case sorts its self out and in thier eyes the charges are fair .... if they are so fair how come they and every other bank out there are changing all the charge scales to make it less expensive (well all apart from hbos with the daft £1 per day charge ....)

they sent me a letter asking me to detail all my in and out goings ..... should i fill this out and return it ?

am not too sure if i should do this or not as i dont see what they need to knwo the info for other than to assess if am so skint that they can get away with offering much less than my original claim (£5202 excluding intrest). in the letter they said they had looked over my account and claim that my account looks in a good state so they see no reason for me to be able to push this along under the finacial hardship rules .... intresting as i havent paid any money into my account (that is over drawn by £1112 as of today) as i was made redundant and on the advice of an account i looked to go see about debts and trust deed opened a new account with the co-op for the money i do recieve.

just how they can say we have looked in to your account and all good fine seeing i havent paid any money into the account for 3 months i dont know.

    This is standard. Unless you return the Income & Expenditure form, they will not assess your claim under financial hardship.
  • yeah i undestand that but why do they need to knwo this info ? do you think they are doing this to look at each case and see who they can make a lower offer too ?

    i will send it back as no harm in doing so, will keep you guys posted but by the sound of what i have read in the press the test case will go through in the new year so they will have to pay up in full anyway it seems

    unless of course there is yet another loop hole !

    Because without it they or anybody for that matter couldn't make an assessment as to your financial status. Definitely send it off and don't assume the test case will result in refunds any time soon.

    There is no loophole. The Supreme Court are NOT deciding on the fairness of bank charges, only if the regulations concerning contracts applies to bank charges.

  • well been a while since my last post and thew sad news is that after sending all the bank charges stuff i got no where

    as you may have read i was claiming back £5000 in unfair charges from hbos, all the charges were correct and validated by hbos but they said i wasnt gettign anythign near that amount as the test case failed (like they said it would) what i got offered was £108 which i wrote back saying thanks but no thanks and pointed out that the £108 was more of an insult than offering me £0.

    i would love to hear off anyone who is having any new luck with bank charges and find out if its worth my time going through the whole proccess again with them or is it still too soon, i havent heard anythign about the new court challange ... is one going to be mounted or is its now dead in the water and the banks have won AGAIN

    Govan Law Centre have an evidential case on Thursday(I believe) in Scotland which is based on the CCA arguments but we will see if this does lead to anything or nothing.
