on the sick with broken leg and ankle

i recently broke my leg and ankle quite badly and am going to be off work till next year. im currently recieving £50 odd a week sick pay. is there any incapacity benefiti can claim on top of this? i have been told i might be able to

    Incapacity benefit no longer exists.
    Can you give us more info eg age/partner/children etc?

    If you are only entitled to £50 sick pay, and are in your SSP period, then you can claim Income Support.
  • I don't think you can claim ESA (the replacement Benefit for Incapacity Benefit) until your entilement to Statutory Sick Pay (SSP) runs out.

    You definately cant be entitled to SSP and ESA at the same time.

    Why are you only receiving £50 sick pay? Are you not eligible for SSP?

    ah im actually recieving £86 a week now which is a bit better just got £50 for the first week because you cant claim sick pay for the first three days on the sick.

    In that case you are not entitled to any further benefits.

  • update, going back to work in new year, and have been getting £86 a week ssp. but i was told by a friend last night who works for the job centre that i will have been entitled to employment support benefit all along, just been on the website and it says this.

    "You may be able to claim Employment and Support Allowance if any of the following apply to you:

    you have been getting Statutory Maternity Pay (SMP) and have not gone back to work for your employer because you have an illness or disability which affects your ability to work "

    "Contribution-based Employment and Support Allowance

    You may be entitled to claim contribution-based Employment and Support Allowance if you have paid enough National Insurance contributions."


    im 24 and still live with my parents, can anyone help? i hope i havnt been missing out on an extra £50 odd a week, i never bothered following it up originally because ppl on this forum said i wouldnt be entitled,but now this person who works for the job centre reckons i definately would be.
