If he stayed over more than that, they would probably feel that you are living together.
Don't let them frighten you. He may have forgotten to notify a change of address to someone, which is easily sorted - as you say, he has a mortgage to pay.
They could indeed have forgotten to tick something saying that the adult female living with you (your daughter) isn't your partner.
Some %%%% could have tried stirring it up because you or your ex upset them by parking in their space.
Many things. You have beggar all to worry about.
I had an investigator turn up at my home unannounced many years ago. I thought I was in deep trouble because my boyfriend had stayed over quite a bit.
Turned out he was there because my ex was also claiming as a lone parent of my daughter and he wanted to see where she lived - I suggested he go and look at the mess she had left in her room that morning before leaving for school.
Ten minutes later he said thank you and left.
You haven't done anything wrong. So don't worry about it.
Oh, and ask them to reconsider your IS claim, as being on DLA should have meant you stayed on IS rather than being moved to ESA when your daughter reached 18, as you aren't claiming as a single parent, you're claiming as medically unfit and exempt from the PCA. Go to tribunal if necessary, as it won't cost you anything.
Thank you for replying,
I am hoping this is just a mistake, fingers crossed, I have never been told about the 3 night staying over rule, or had it in a leaflet etc, all I have read, is change of circumstances bit, where you have to notify them of changes, which there is not any on my part! It really beggers belief that your private life is looked into like this, I had my brother from ireland stay with me for 2 weeks back in Jan this year, because of my mothers death, had to arrange funeral etc, so would this mean I should have rung them up and told them he was visiting me and staying on my sofa for 2 weeks? this is such a grey area.
As for IS, I was told by the lone parent adviser I had to come of IS because my younger daughter turned 12, and under new rules for lone parents this is the case, I did have the disabilty premuim attached to IS at the time, which now I do not get, so I have less money coming in now, I didnt know about this, i will look into this, Thank you again x0 -

Whilst I agree that the OP is in an awful and very stressful predicament and should note everything down that she has posted here for their solicitor I have to say that the benefits office compliance officers don't know who the "Real Scum" are until they have done their investigation.
We don't know what has prompted them to investigate this OP, it could be that someone has made a malicious allegation about them but they are duty bound, on the taxpayers behalf, to investigate anything that could be a potential fraud. It could be that as soon as the OP answers their questions that they will see that no fraud has been committed by the OP and their investigation will be closed. This is a system account and does not represent a real person. Get advice, don't rely on me, but if they told you wrong (which I believe they have) you send them a letter saying you want to appeal against the decision on those grounds attaching a copy of your DLA award notice, you stay on ESA for the course of the appeal, they either pull their fingers out and sort it, or you stick with it and go to tribunal, where, if I am right, the decision is made that they are wrong and they have to reinstate your IS and make backpayments if they owe you anything.
Get the wotsits back for putting you through this!I could dream to wide extremes, I could do or die: I could yawn and be withdrawn and watch the world go by.Yup you are officially Rock n Roll

No, I used to get IS with a disabilty premuim attached, which was roughly £24-25 a week, (sorry my memory fails me exact figure), but because of new rules to do with lone parent and child ages, which is at the moment 12, but will be reduced to 7 soon, I was told I no longer can recieve IS and would have to apply for the new ESA which I think came in last Oct 08, because of my illness that was put towards me at the lone parent adviser interview I had in sept this year and the lady advisor did the form for me that day, I am now in the assement phase part, this in its self has been very stressful just filling out the huge questionnaire that they sent me, and I believe I may have to have 3 medicals of some kind too to do yet :-(I'm guessing you got Incapacity benefit with Income support as a top up, would I be correct?0 -

This rule regarding DLA is only recent (August 09) - prior to that, JC guidance was to swap LP onto ESA.
DWP did not, it seems, consult the right 'legal' people & from August 09, any LP whose IS will be coming to an end due to the age of the youngest child & who says they are too ill to go on JSA, will remain on IS & claim IB credits instead.
You can actually appeal & ask for this to happen - DWP are expecting a small number of LP to appeal once word gets out!!!
Hope this helps!Oops!! Should I have posted this??? Some users don't think I shouldn't be offering advice due to my occupation!!!
