Sorry another question:
If I stop making minimum payments can a DCA mark a default against me, even if the OC already marked a default against me for the same debt?
I'm just trying to work out my best course of action for these debts, considering my situation, income, etc.
No mate - one debt = one default so what will happen is the new DCA will change the default to their details, using the original date of default. (well that is what should happen). The 6 years remains from original default date by the lender or whoever added it originally.2010 - year of the troll

Can also confirm this. Two of my debts have been sold onto DCA's and the defaulted credit file just transfers to them as it is the same debt, not a new one.

N-I-D. You are an absolute star. You've been a great help. I've downloaded the forms to send for my credit reports, but i've hit a snag. Was filling out their online forms (Equifax & Experian) and although they both took the £2 from my debit card both have asked me to fill in paper forms and send proof (copies ok) of ID (passport, drivers licence), and proof of current address (2 bills or similar). Is this normal? Should I send them to Call Credit too with the application just in case?

I SAR'd 1st Credit a while back and all they sent me was:* Printout of all activity on my account* A Notice of Assignment* 3 years of statements (not 6, even though the account had been active for that long)Should they have sent anything else?Thanks,Cocker:)0

Yes mate this would suggest they cannot locate you electronically or that they just want to confirm you're the same person.
Just copy your passport and a utility bill and send a £2 cheque with each CRA and a copy of ID.2010 - year of the troll

The NoA allows them all rights you allowed the OC so they can add the default (transferring it from OC) using your original terms. They may not have issued a DN as all they are doing is transferring the original DN - they are not defaulting you directly, moreso transferring the Default from the OC to them. Only one default (per debt) can be issued remember.

Hi all, I have a debt with Capquest that I started paying token payments to them of £1.00 per month in Feb 2008 after they sent me a copy of my C.C.A , They original debt was taken out in 1999 and I stopped paying the account originally in 2001.
Have I been paying a debt that was statute barred when I commenced payments in 2008?

Thanks for your reply. So if the NoA allows them all rights of the OC, does this also transfer all liabilities of the debt onto the DCA?
I'm talking PPI reclaim here!:D:D:D:D
Many people suggest reclaiming PPI should be through the OC.
What do you if both parties refer you back to the other?
