Contact @ Work

Hi,
Ive looked through many pages, but cant seem to find any thread, sorry if there is one.

My girlfriend was recently contacted at work from Capital One, regarding the 2 months arrears on her account. The phone call was answered by a colleague, who asked what it was in connection to. The Capital One caller quite openly said, "its Capital One, and we would like to discuss the arrears on Miss XXXX account".

Now, im not too clued up about Financial practice, but surely discussing personal details with 3rd parties are against the code of conduct??

My girlfriend spoke to them, and said that they shouldnt be calling at work, and the payment would be made on the 18th (next week). The Capital One caller said "i can make a note, but we will continue to call at YOUR WORK until payment is recieved, and theres nothing you can do about it" Even though they will get the same answer every time until the 18th November.
This guy was very arrogant and cocky, and now my girlfriend is obviously worried about recieving many many calls to her work, which will not go down to well with her supervisors.

Could someone please advise us what channels we need to go down in order to stop these calls. A fairly quick option would be much appreciated as from now until next thursday (when she pays) she would prefer not to be contacted.
Also, they have contacted her mums address (where we havent lived for close to 3 years now) and her mother now thinks we are in severe financial trouble.

    Well confirming to the 3rd party that an account exists is the only thing they have broken here.

    they should of said,

    Would like to speak with........
    It's a personal business call

    This would of been better.

    The call should be recorded so good grounds for a complaint.

    Write a letter for the attention of their compliance department.
  • I am not sure if there is any rule about them calling at work possibly not as they can contact your employer to attach a statement of earnings and draw the debt from her wages.


    Can she not make any payment at all? B4 the 18th they will ring and ring a friend defaulted and they rang her number from 8 to about 9 pm about 12 calls a day.

    unfortunately not, as we have no monies in our bank account until then, next week we would be paying the full balance, so we dont have to deal with these arrogant call centre advisors again.

    It seems as if she will have to just grin and bear it for the next few days.

    I did read on another forum that a loan company had tried to contact a young women whilst she was on holiday. They had left a message with a friend of the customer (who was looking over the house) and divuldged information regarding arrears on the account.
    Once back from holiday the customer complained to the loan company and they actually wiped the debt as a "bribe" not for the customer to take it any further with the correct authorities.

    I have no proof that this is true, but i just wondered if these things really do happen, and obviously there must be some sort of Data Protection Act.
  • i know they are a pain but if you can afford to clear the balance in full why did she fall into arrears? All you have to do is make the minimum paymentr and you can set up a direct debit now so you dont have to worry about it.

    Dont cancel the card unless you are happy to be without one as if your two months in arrears its unlikely any prime lender will give you another credit card for a few years.
  • When she completed her application she authorised capital one to contact her at work. The issue is that they have broken the Data Protection Act. If I was you I was write them a stern letter advising them that you are changing your terms and conditions and you withdraw the right for them to contact you at work and they must delete the work number from the database. I would also complain and try and get some compensation
