Faulty PS3 Saga

Hello,
I was wondering if you could help.
My oh had a ps3 that was bought on launch day in 2007 and in the last few months developed a fault, we spoke to consumer direct who advised us to get in contact with the seller Game to arange repair.
We have done this and had the ps3 returned to us twice now with the same fault and on the last return to us it was damaged by the repair company. The upshot of all of this after numerous calls, lies, and terrible customer service is that Game authorised for a brand new replacement in our local store and for us to take the faulty one into store to swap for a new one.
When we got to the store, the manager there would not accept the faulty one in the store as it would just sit in the stock room, but let us walk out with the new one with no problems.
We now have the faulty one sat here and we are happy for it to go back but i am not willing to send it in at our expense when they do not seem to know what they are doing and i dont really ever want to speak to them again because they are useless. Am i within my rights to hold it here until they ask for it back or if they dont how long before we can dispose of it?
Many Thanks
Michelle

If you did what they asked and they essentially refused to accept it then I'd have thought it's now yours to do with as you please. They can't expect you to store it for them (in fact I think you'd be legally entitled to charge them storage fees if that's what they're considering you as doing). I haven't looked into this in depth in a long time and it's all from memory so maybe someone with better knowledge may clarify."She is quite the oddball. Did you notice how she didn't even get excited when she saw this original ZX-81?"

Thanks for the reply.
We did exactly as they asked but the store turned the faulty one away. I would contact them to arrange collection but i am struggling to see why i should spend anymore time on this and then waste another day waiting in for collection when they can't organise themselves so that the store and head office know what they are doing. I think i'll just wait and see if they get in touch, they haven't so far and this was on sunday so will wait and see before deciding when to dispose of it.
Many Thanks
