Help with going bankrupt

Hi i will be declaring myself BR within a few weeks, whilst i know i could go through the whole process myself i would feel more reassured if i had some legal assistance with form filling etc, i know someone who does this and there is a charge involved although it is not that expensive compared to other solicitors, what i want to know is would i be able to pay for this legal service (approx £300) out of the money i made when i sold my car? (which was worth £6K so i was advised to sell it and get a cheaper one which i have done). Any advice would be welcome, thanks.

    There is no need to pay someone.....we do it free.lol


    Seriously take a look at the forms carefully they are not that complicated,especially if you read the notes which accompany them.If you get stuck ask away here. If after you have done that you still feel you would like "expert" help,then that is your choice.


    As far as using some of the car proceeds to pay for services...not sure.


    But make sure you leave a paper trail of all monies spent from the sale as the OR will want to know. Also i do hope you sold the car at the correct market value,as underselling is a big mistake and seen as selling off an asset. Just out of interest can i ask who advised you to sell the car?

    Please make sure you also get the advice of one of the debt charities, your petition could be delayed by the court until you do.

    Hi i have been advised by various people including the CCCS that it would be ok to sell my car because i needed money to afford a deposit and rent up front for the flat as well as furnishing it etc, and also i could get a cheaper car upto a certain value for getting to and from work etc, most places have said this would be ok but im not sure about whether i could use some of the money for a legal assistant to help with filling the forms and for guidance etc.

    Why use money(lets face it these are hard times) for something you could so easily do yourself with a little time and effort on your part?.

    I did the forms totally by myself(never knew about this forum then)with just the guideline notes and a little patience. Unless you have a very very complicated petition(even then not sure why you would want to pay someone) paying someone is not needed. Gettng help from a solicitor ect will not mean your bc will be any easier or guarentee you ED......if it did we would all be doing it lol.Dx

    I'm not sure really, it isn't essential as the forms are very straight forward so it's an unnecessary expense, and something CAB will do for free. The hardest part is gathering all the information, which no-one else can do for you.

  • Hi Inamess. The CAB are doing ours for us (for free) - I felt the same as you, could have done them myself but just wanted that little bit of extra assurance. Our caseworker stays in touch with us throughout the whole process and both myself and my OH (who is also going br) felt we needed a third party on board.

    Saying that - the members of this forum can also help you with any queries you may have - their advice has been exactly the same as the CAB's, they haven't got a single fact wrong :money:so it's up to you really. I certainly wouldn't advise paying for it, get in touch with the CAB if you do want that extra back up but be prepared for a wait, they are really busy just now.

    Hi again thank you to all for your replies, i have been in touch alot with the CCCS although when i try and ring their bankruptcy line i can never get through!!lol Could i still use the CAB as well just for help and reassurance with filling out the forms and the process etc? Thanks again
  • Yes you can. Although they are extremely back logged at the moment so it could be quite a wait to see a debt specialist.

    Why don't you tomorrow register with the IS and have a look at the online forms and then using the links for example forms and asking here make a start. Remember to save often though as the IS site can be a little hinkey.
