Hello, I live with my OH who has nothing whatsoever to do with my debt, do I have to declare his salary on the form?

Hi Susie54,
Yes you do, its the "household" income that they will be asking for even though he has nothing to do with your debts.

They arent interested in "him" in particular and wont be asking for any proof of his income etc.
Its all about your income/expenditure and how much "excess" funds are available at the end of every month.
If your excess passes the £99 barrier (per month) then you will be liable to pay an IPO (income payments order) and that stays with you for 3 years.
If you post your statement of affairs on here, there will be many people who can help you with the figures and what is allowed to be included in your SOA and what isnt.

Im not sure what the CCCS meant by saying that? Thay are correct in saying that it is a "personal" debt but you HAVE to put his income on the form, like I said earlier, its the "household" income that the Official Reciever will be interested in.
By the looks of your SOA, you partner pretty much pays for everything at the moment but a prime example is the Groceries, 2 people living in a house are allowed up to £500 a month for food (that was on my expenditure for for my BR and my examiner said that was absolutley fine.
They will want to see how much rent you pay, electricity/gas etc etc.
I do not know the alowed amounts but im sure someone will be along shortly to guide you in the right direction!!:D
And no, it doesnt matter that you arent married, im not married to my missus but have had to disclose her earnings as has everybody else.

Hi susie, the reason you put down the partners income is that they want to see that he is paying a fair share of the household expenditure. They will not take any of his money but if he is earning 50% of the household income he will be expected to pay 50% of the househld outgoings they then take the other half and put it against your income so they can see what your surplus is. They will adjust it for other percentages. i.e if he earns 75% of the household income they will expect him to pay 75% of the outgoings before deciding what your surplus is etcHi, im Debtinfo, i am an ex insolvency examiner and over the years have personally dealt with thousands of bankruptcy cases.

sorry, i've got a question about this, i'm unsure now. i was under the impression that on the soa i need to put my partners contribution to the household, and not their full income. if i put his full income then the soa doesn't take into account his own outgoings. please could you clarify, i am having a dim moment

The OR can ask for the full income to be put down as the contribution should be based on their percentage of the household income relative to the outgoings. For instance say the partner (none bankrupt) earns £1,000pm, the bankrupt earns £500pm and the joint outgoings are £500pm. The partner cannot say that because they have their own debts of £999pm that they should only contribute £1 pm rather than 2/3s £333pm.
However the OR can ask to know the partners income but cannot compel the answer. Instead if the Bankrupt is unwilling to tell the OR the partners income the OR can assign only half the outgoings to the surplus calculatio and ignore what the bankrupt claims the partners contribution is

ok thanks debtinfo, i'm with you! sounds like partners details are looked at more than i thought. this isn't particularly a problem, however my partner has his own debts to keep on top of. not much i can do about it at this stage (except worry)! thanks for the heads up0

. Does it make a difference that we're not married? Right my sweet, stop panicking. You need to do your SoA with all the household bills on it and your own bills. You then put your full income down and your OH contribution to the joint household bills down.joint
