The OP is not disputing that £140 isn't enough and is quite happy with the amount. Unless she cashes the cheque and then writes to the Council eithr before or immediately after (they could then stop the cheque) saying the £140 isn't enough she has no further claim for the drawers.

I presume she put the figure of £140 to the Council in the first place?

Yes they sent the cheque with the letter, thank you all so much for your advice.

I think I will hold off on banking the cheque in case it is acceptance of their statement and take some legal advice, maybe get a solicitor to right a letter or something.
Don't waste your money on a solicitor just go to the CAB or your local legal centre and ask them about this, and your housing rights to have the issue resolved properly. You may have to wait for an appointment.

I am happy with £140 but I'm just worried that if I'm in the same position in 12 months I will be signing away my right to complain again if more of my property is lost and my kids continue to have health problems.
The health issue would be nearly impossible to prove. However from what wrote you seem to be signing away your right to complain again if you have more stuff destroyed due to the same issue.

Obviously I cant put a price on my childrens health however would home insurance would even cover me for belongings given the circumstances?
    .
It should do. However if you claim you insurance premiums would go up.

I am aware of the law on full and final settlement.

Which is why I told the OP to make it clear that the cheque isn't accepted as full and final settlement.

Another posted suggested that she cash the cheque and say nothing except she received the cheque, which is why I quoted them.
