help and advicc needed please with my employers

    I DID NOT GET CAUGHT FOR DRIVING WITH OUT DUE CARE AND MY LICENCE IS ACTUALLY CLEAN AND I HAVE NO ENDORSEMENTS ONIT, I FEEL REALLY HARD DONE BY I WAS THERE MOST SUCCESSFUL EMPLOYEE WHEN I JOINED THE COMPANY THEY WERE TURNING OVER ABOUT 100,000 PA LAST YEAR THEY TURNED OVER 10 MILLION I WHICH I CONTRIBUTED 6 MILLION TO THAT, I FEEL THE COMPANY ARE NOT TRYING TO ACCCOMODATE ME IN RETURNING O WORK WITH MY DISABILITY I HAVE TRIED TO KEEP THEM UP TO DATE THROUGH OUT, MY DOCTOR TELL ME THAT THE CAUSE OF MY STROKE IS MORE LIKELY TO BE THE STRESS OF WORK AND THE SPEED I WAS WORKING AT AND NOTHING ELSE THEY HAVE FOUND NO OTHER EVIDENCE FOR THE STROKE IN MYMEDICAL HISTORY. THE LAST MEETING THAT I HAD WITH MY EMPLOYER WAS THAT I WOULD RETURN TO WORK PARTTIME AT FIRST DOING TRAINING WITH NEW MEMBERS OF STAFF ECTBUT THERE INSURANCE WOULD WANT ME TO GO AND SEE A SPECIALIST DOCTOR FOR A MEDICAL TO SEE IF I COULD BE COVERED FOR WORK, HOWEVER THIS ALL CHANGED AFTER I HAD GIVEN THEM THE dLA REPORT WHICH IS WHEN IT WAS SENT TO THE LAWYERS, I FEEL I HAVE ALWAYS BEEN HONEST WITH THEM AND THEY ASKED ME FOR THE DLA REPORT WHICH I GAVE TO THEM AND NOW THEY ARE PENALISING ME WITH IT

    Actually, I don't think the DLA report was any of their business - you can claim DLA and still work, the two are not connected.

    However, if it's clear that you are not going to be fit enough to return to your previous job then yes, I believe they can end your employment, even if you are disabled, if it's not possible for them to make reasonable adjustments.

    Have you heard of Different Strokes? They are for younger survivors of stroke, and may be well placed to advise you.

    I would have thought it sensible to share the report with them as they need to make 'reasonable adjustments' if she's going to keep working there.

    Would she be liable if there was an accident as the recommendations in the DLA report were not met because she didn't share them with her employer by either informing them of the requirements or sharing the report?

    Did your GP sign you back as fit for work after your visit to OH?

    It sounds to me if the company are seeking legal advice they may be thinking about trying to dismiss you on the grounds of incapacity. I'm not sure if I'm right with my next comment (but I'm sure someone more knowledgeable will confirm) but because you have technically become disabled the company has to investigate whether any reasonable adjustments could be made to enable you to return to work.

    My mind did jump to ill health retirement, but I'm not 100% certain whether this is relevant to your case.

    I'd have thought that the company should have sought advice from their Occupational Health doctor rather than asking for the DLA report, myself, although by the sounds of it the OH person was as much use as a chocolate teapot last time.

    I haven't previously heard of an employer asking to see a DLA report, either. But maybe it's a regular thing.

    Anyway, Different Strokes are the people to contact. They will have met similar situations before.

    thanks to sue savvy for your advice i am already a member of different strokes and attend a fortnightly support group run by them

    my surgery not my own personal gp signed me back to work on the basis of the report from the private ocupational health doctor who was paid for b my company, my won gp was not pleased with me being signed back to work, we have since discussed the depression with her and she says she is not really suprised that i got depressed just for having a stroke at 47 years old would be enough forto caused this
