help and advicc needed please with my employers

:mad:on January 5th this year I was rushed in to hospital suspected of having a stroke, after various tests it was proved that I had indeed had a stroke I have worked for my current employers since early February 2005 and always done my job to the best of my ability, my employer has made comments to people around me saying that the company would not be in the position it was today if they had never employed me whilst I was in hospital my husband notified my employers of my illness when I was released from hospital I told my employers saw my gp the next day who gave me a sick certificate for 2 months, the next day my employers can out to see me at home I was still fairly week and sick at the time so I gave over my sick certificate at this time they asked me when I would be returning to work my reply was when the doctors said that I was able to but I had been told by the doctors that the stroke had in fact caused me a brain injury I will apologies now for this post if it is difficult to read due to lack of punctuation ect but I do not think that way any longer in
April this year my employers asked again when I would be returning to work I told them I would go and speak with my doctor, my gp told me that she would not be able to sign me off the sick because of the work that I do my firm would need to speak with the occupational health advisor I explained this to my employers who arranged for me to go and see an occupational health doctor at a Bupa hospital in London, my job is that of a medical representative and I was the top employee with them for the last two years
when I went to London to Bupa I did not want to go on my own as my left leg and left arm where still a little weak so took my friend with me but I was exercising every day to improve this, I had reported the stroke to the Dvla as I was duty bound to do and they wrote back to me saying I could keep my driving license after speak ing with the e consultant at the hospital, the occupational doctor did not know what had happened and why i was off work so i told him he did not do any medical just asked me a few questions and asked me what had been wrong with me I explained about the stroke his reply to me was it is very early days to consider going back to work after such a serious illness, but what did I want to do
I explained that I wanted to get back to work as soon as was possible, my friend who attended the appointment with me was asked for her oppinion as she had known me longer than any one some 20year friend ship, her response was that I was still not fit for work whilst i was in the doctors office my employer rang to speak with the doctor he told him that he was seeing me right now,
with this the doctor reported back to my employers that he saw no reason why I should not return to work before the end of the month this was April I agreed to go and discuss this with my employers and it was agreed that I would go back to work working mornings only at first and build up gradually, commencing the 27th April 2009, however on the first day I had a very early appointment and had to drive about 100 miles to my first appointment so left home at 6.00 so as not to be late my second appointment about another 40 milesaway from the 1st appointment my 2nd appointment of the day over ran and this lead to me leaving after I was due to finish work so at the end of the appointment I left to go home some 140 miles to travel about 3 hours whilst I was driving the office telephoned me at this time my company car did not have a hands free kit in it so I answered the phone and told them I was driving and to make there conversation quick whilst I was on the telephone a car can up behind me and crashed in to my car causing some damage, I put the telephone down pulled over and exchanged detail with the other driver who was shouting at me saying I should not be driving I explained to the other driver that I had been off sick from work for some time after having a stroke, his reply was that in that case I should not be allowed to drive I told him I had been cleared by the dvla to drive again, he tried to say that because I had had a stroke it was my fault for the accident I told him I was going to call my employers which I did, my boss spoke to the other person and he admitted that the accident was in fact his fault, but this left me in an upset state of how I was now going to get 140 miles home I called the AA who came to my assistance after about 2 hours I was now very tired they decided that they were going to take me to a garage to get a replacement car so that I could continue on my journey home after changing the car I eventually arrived home exhausted at around 8.30 pm that night, next morning I go up for work and because my company car was a petrol car but the car that I had been given was a diesel car which i was not used to using with only enough fuel to get me home the evening befefore I called in to the petrol station early next morning to put fuel in and forgetting managed to fill the diesel car with petrol, so was stuck, called my boss and told him what I had done and appologise his reply to me was this quote
“you are starting to !!!! me off now you need to start to think a bit” I told him that that was the problem that I did not thinkbecause i was now brain damaged from the stroke and ended up in tears, I went back to my gp whom immediately signed me back off sick and wanted to know whom had told me I was ready to go back to work , I explained about the occupational doctor in London and said I had seen a another doctor in the practice because I could not get an appointment to see my own gp, and gave him a copy of the letter from the occupational health doctor that I was sent to privately, shortly after I was re admitted to hospital again diagnosed with severe depression, during this time the community physiatric nurse asked me if I had applied for disability living allowance as I was now on statutory sick pay only, I told her I did not think I would be entitled to it so she said in her opinion i would be awarded Dla and that she would support my application along with the consultant physiatrist eventually in October I was award DLA at the middle rate,
I told my employers I had been awarded DLA and they asked me to fax them a copy of my letter which I did, my employers are now saying that they do not know if I will be able to do my job as the DLA letter says that I need to have supervision throughout the day so as not to be a danger to myself an d others around me and that they have now sent my file on to their lawyers for advice on my case I am at my wits end with this now and want to return to work as soon as possible for my sanity if nothing else
but feel that I am being beaten up by a report that was told to the DLA since seeing the occupation doctor to return to work in April apart from seeing my physiatrist and gp I have not had any medicals done on me to assess whether I am fit for work or he only other treatment i have had is to have another MRI scan to assess the level of brain damage that i have the consultant told me when i went for the results of the Mri that the MRI scan showed a small tumour on my
Pituitary gland and he was refering me to a neuro surgeon for advise and also that my blood tests showed that i was anemic which would make me feel extremly unwell.
can some please advise me on this please once again i will applogise for the inchoherence and spelling mistakes in the post but really need some sound advice on this matter

Tbh I think your employers have acted entirely reasonably.
They followed through on the report of an OH expert and following a further relapse during which you reported extreme disabilities and medical conditions which indicate that you are unlikely to ever to be able to return and function properly they have decided to seek advice as to your capability.
90% of your post is irrelevent. The bit about the accident you should count yourself lucky you didnt face criminal prosecution and the petrol is no ones fault.
Part of me is doubting that this is even a genuine post.0 -

why would any one make something up like this i have just had the worst year of my life to date and am only 47 years old i have always been a very good employee and worked over and above what has ever been asked of me to do

Anaemia should be treatable, and you will indeed feel ghastly while it's bad.
Why anyone thought that driving 100 miles to your first appointment after a protracted sickness absence was a good plan I cannot fathom, but there's not much to be done about that now.Signature removed for peace of mind0 -

[I assume ‘can my employers penalise me for a disability? Can they make me unemployed for this reason after 2+years good service? Do they have to make reasonable allowances for my mental health/medical condition caused by the tumour?]

I dont mean to be harsh but do they have a case for dismissing you for not having a clean license - assuming that you recieved an endorsement for using your phone when driving (and being involved in a crash - driving without due care)0

If the other driver admitted fault on his insurance, and took it no further, then there would be no record of her talking on the phone, just that she got hit by someone else.
Plus, even if she did have points on her license, unless a clean license is a requirement of the job, 3 points shouldn't make a difference.Almost everything will work again if you unplug it for a few minutes, including you. Anne Lamott
