thats all well and good but if the bank have an acceptance form signed by me saying that the £1500 is a settlement to my bank charges ,than i aint got a leg to stand on.i can kiss goodbye to the the rest of my charges weather the court case goes in the publics favour or not.
i dont think you realise the significance of a signed and dated acceptance form saying it is a settlement of your bank charges claim,there is nothing on this letter to say i can claim more when the test case is over,they have worded it very cleverly indeed.missed direct debit charges,very odd,theres no pain so how come the big gain,i.e £39.00 for a letter0 -
Have you read my post Chris? Bottom line is that they CANNOT EVER offer a full and final settlement of the whole bank charges complaint whilst the FSA Waiver is in place because it is a breach of the FSA Waiver on bank charges.
Either way you look at it, they simply cannot do that.0 -
im sorry but it does matter what my letter says,the fsa and fos have been no help at all,and the halifax are refusing or cannot reword there offer of an intrim payment,its sign, or get nothing untill the test case is over,there trying to pull a fast one,and im not buying it
this is the wording exactly................i/we confirm that i/we accept a total amount of £1478.26 in settlement of my/our unaranged overdraft bank charges complaint.
Just write a letter to them with the reference on it and say you are accepting the interim payment but reserve the right to reclaim the outstanding amount on the conclusion of the OFT test case issues.0 -

I and Alpine have said it cannot be in full and final settlement of your claim.
I guess the question I have for you is How much more advice can we give?
I gave you a phone number to call so JFDI and then ask as much questions as you want.
Speak to the FOS with regards to the acceptance letter and wording because Halifax are being extremely precise on an acceptance letter. In fact I would call it petty with regards to you writing an acceptance which could worsen financial hardship which the offer is there to alleviate.0 -
yes you have given me excellent advice,i have contacted the fos and the fsa but they were no help im afraid,im tired of fighting this,i need a rest from it now,ill be fighting again soon enough though.
