Im confused.
I was watching the TV prog the other day and some chap came forward from the gathering in the street and said something along the lines of "well people know that if they go overdrawn they will be charged" I thought fair dinkum as lets face it thats the truth I mean if you dont go overdrawn you wont get charged its as simple as that, and you replied with a comment about slapping, What was all that about then, did make me laugh though.

The fella in the crowd was meaning that people agreed to it as it's in the terms and conditions of the contract you signed , so legal.What Martin was quite rightly saying was if I gave you a contract and in it it said I could smack you thaa=t doesn't make it legal for me to smack you.In other words just because something is stated in the T&C's does not mean it is lawfull.
The charges are in the T&C's but they are penalties so unlawful and this is backed up by case law going back to the 1800's to present day.Wish I could stop editing EVERY post I make :mad:0 -
