advice needed

Hi,

My parner has been told today (with her colleagues) that all of the jobs are being restructured and that her post amongst others is being closed.
They are going to internally advertise new roles. The new roles are not really suitable for her (lesser pay and different type of work for ceryain posts and different experience required for other post) so she is thinking of not applying for any of the roles being advertised.
The word "redundancy" was not mentioned at all in the preliminary meeting.
I was wondering if she can claim redundancy even if she does not wish to apply for the advertised jobs (which there is no guarantee she would get anyway). I am a little worried that the employer may be pulling a fast one and claiming that as the employee does not wisdh to apply for new positions then no redundancy is owed.

I could do with some advice.

    It will all come down to comparabiility.

    The company are entitled to move her to one of the new roles if they can argue it is a similar role.

    If they are making new roles I would be surprised if redundnacy is offered.

    By applying, she would be giving tacit acceptance of the lower pay. By not aplying she risks losing her job - but it would have to be through redundancy

    The other thing to consider is that although the positions might be lower pay a lot of employers offer to retain current pay for a period of time or even until the others in that role catch up
