Help with Car Warranty Issues Renault Vs Peugeot

Hello, this may be a little confusing to follow so I will try to explain as best I can.

In January I purchased an 04 reg Renault Megane, from Perry's Peugeot in Bolton.

The day I picked the car up, there was a service light on and also an airbag light. As the car came with 6 months warranty, they told me not to worry but to book it in at my local Renault garage to have any problems fixed as they couldn't fix it there and then as they are a Peugeot dealer and not a Renault dealer.

So that was fine, I booked the car in and had the work done. Also while it was there Renault discovered several other things that were wrong and that all got sorted as well. One of the problems was my window, it would go down but get stuck and no go back up again. As they sorted this problem, I was happy with all work done.

Until... a few weeks later, the window gets stuck down again. I book it in, they fix it, I get my car back. A few weeks later, it happens again!! This time, after they've fixed it it's ok for a couple of months but then... guess what? It happens again!!

This kept happening and now I am at the end of my tether.

They have discovered that the part they have been replacing for the past 9 months, is actually not the problem at all. But now they have found the "real problem" they are saying it is not covered by the warranty any longer.

My main question is this: I reported my window to not be working correctly within a matter of weeks of having the car. Therefore as far as I am concerned the problem was recorded during the warranty period and should therefore still be fixed.

But Perry's are claiming that they cannot fix it as the problem was not found within the warranty period and are claiming renault should pay for the new parts and labour.

Renault are saying Perry's are responsible and will not do the work without payment first.

So I am stuck and I wondered if anyone knows where I stand legally on this matter?

  • Renaults do like to break their window regulators, we get sick of replacing them.
    I think you should be talking this up with Renault as they have mis-diagnosed the problem - to be honest they should know better!

    The airbag light could be a few things - is the passenger airbag turned off? - The switch is on the end of the dash on the drivers side (viewable with door open). Renault's use the "SERVICE" light when there is a fault - it's a French thing.

    I don't think I would ever have accepted the car from Perry's in the first place. I wouldn't trust anwhere that sold me a vehicle saying don't worry about it- take it elsewhere and they'll fix it under warranty. Perry's should have done that before selling the vehicle.

    Anyway, you did accept it, so...
    I would agree, the fault was reported within the warranty period and the dealer has admitted they failed to repair the fault correctly (having changed the wrong part) at the time so they should repair it properly now at no cost to you.
    If they don't, pay invoice but mark it as "paid under protest", then take the matter up with Renault UK directly.

    You're unlikely to get anywhere with the original selling dealer now, I'm afraid.

    they are now covering their backs by saying it is not an old problem, but a different part that has gone wrong.

    How convenient, to a non-mechanic the car went in with exactly the same problem, the window goes half way down but will not go up again.

    So far they have been blaming the window motor/mechanism, now they are saying it's the wiring and that the wiring is not covered under the warranty!!

    That is different to saying that they won't fix it because the warranty has expired.

    Yes I know it is, that is what they said. The wiring is not covered by warranty.

    However I have called another main dealer in the area who confirmed that wiring should be covered by warranty.

    Renault know full well of the problem with the window regulator of cars from 04 up to 06. They have unofficially agreed to honour repairs by extending the warany on these from 3 to 4 years,(you have to press the Renault dealer for this). I know it does not help you directly but is usefull background info;)

    You need to get to the bottom of this, but's not going to be easy I'm afraid.
    If they were fixing the wrong part, that's their mistake.
    If another part has now failed, that is not their mistake (unless you can prove that failure is as a direct cause of the failure of the part they did fix)

    If the part failed after the expiry of the warranty, it's not covered.
    You need to prove it failed, or was failing, when you originally reported the fault.
    If they accept it was failing or failed within the warranty period, but don't believe it is a warranty item, again pay the bill, mark it as "paid under protest" and take up the matter directly with Renault UK.
