Had visit to OR this week

Well I have had my meeting with the OR and it was long about 2 hours but it was relatively painless. She was pleasant, she told me I could take a break, have a cup of tea or glass of water and ask any questions any time.

So I guess it is all over now. My IP is going to send her the paperwork she needs such as statements and stuff like that.

I will get a letter if I am discharged early or if not it will happen automatically on 18th May 2007 and I will not be notified.

Have been shopping with cash, have arranged for tax credit etc to be paid to oh and I have had a couple of good nights sleep.

It is not for everyone, but it was not a bad experience and if you are facing it do not be frightened. There were 3 other people having OR interviews at the same time as me so you are def not alone.

    sorry to be nosy am im glad its a relief from your shoulders but not knowing your history could you explain why you went down the bancrupcy route

    In the end I had no choice. Failed marriage, masses of debt which came to me coz he slipped the country to Russia, no post, no address no nothing except divorce papers.

    I tried to sort out an IVA but as I have been suffering with ill health for the last 5 years - hysterectomy which went on and on and on. Then meningitis which went on and and on and on. Then depression which is still going on and on and on!!!! I could not work so the best I could offer was 15p premium the creditors wanted 30p min.

    I looked at a dmp but would have retired before it was even half way through and unless I lived to about 300 they weren't gonna get it all anyway.

    In the end I went to an IP which everyone advised me against as her charges are £3500 but she will let me pay in installments when I am discharged. She has been my saviour, she has filled all the paperwork, she came to court and the OR with me. She sat in on the meeting (allowed providing she says nothing) and gave me my script for the meetings so i didn't prolong the meeting. Basically the OR doesn't want long answers many of them are yes and no.

    She produced a comprehensive list of all my creditors and put them into sensible format for the OR and will contact all my creditors on my behalf now that we have been to court.

    So the reason I went bankrupt was I owed £140k and could not pay it back!

    For interested readers, the CAB provide this service for free.

    The OR fee is £325. The court fee is £150 but you can often get exemption or remission if on benefits or a low income.

    There are two forms to complete - one long, one short. The CAB adviser (probably debt specialist) can help to complete these in about an hour. In this case the OP has paid around £3000 for a couple of hours work.

    Interesting. As an IP she will be well aware that any debts (with certain exceptions) that you have prior to the bankruptcy are debts that are only recoverable through the bankruptcy. A debt for her fees is provable in bankruptcy and so you have no liability for it when you are discharged.

    What I am trying to say is that you do not have to repay her once you are discharged. There is nothing to stop you paying her once you are discharged, there is nothing to stop you paying any of your creditors once you are discharged. She has not right to say that you can pay her by installments when you have been discharged as you don't have to pay her.

  • i am shocked at this IP I am sure it should be reported to her authorising body as misconduct. yes it is a bankruptcy debt why shoudl she be paid when the rest of your creditors will not be?

    I agree, I've never heard of it happening before. Obviously she can't work for nothing, but £3.5 seems very high and then to say that is can be paid once you are discharged is not right.

    If I were you I would contact her authorising body. There are seven bodies and the Secretary of State for Trade and Industry, but it should say on her paperwork which one it is. If you aren't sure, send me an email and I'll look her up in the directory when I'm at work on Monday.

    Did you include it in the debts that you disclosed to the OR? If not, call the examiner and ask for it to be added.

    What ever you choose to do, don't pay the IP.

    A very good point AtoC. However, it not only a couple of hours work as pointed out by someone else. She has had to put a lot of time into the whole thing and she has had to travel a long way to be with me for my meetings.

    I paid £475 on the court date and her fee is on top.

    Don't know if I could get her included in the bankruptcy as we don't have any paperwork.

    No paperwork?? Is she registered? If she is, that's really suspect. Although, it does ask on forms if you owe family money and family lending very rarely has paperwork so maybe it could be added as it was a verbal agreement? I don't know, I'm no expert!

    I can also see where you're coming from though, it sounds like she's been such a great support and it's at times like those you need someone there. My hubby went to pieces when he was going through his bankrupcy.
