gas safety certificate expired

Please help the gas safety gas certificate expired 6 months ago tenants only found out there was a very small gas leakage when transco where doing gas work in the road and in the houses. as it was a very small leak it was recommended to change all the gas pipes and service the boiler and been issued with new gas safety certificate. last year there was a new gas cooker installed my Corgi guy got a safety cerificate throw the post and also had a carbon monoxide detector installed. also in august i had the EPC done
I been told Health and Safety Executive have been informed anyone what action they will take? the new gas safety certificate says "Next safety check due within 12 months"

Sorry - very hard to understand the position from your post.
I assume you are a landlord with an obligation to provide a safety certificate?
What is the date on the certificate? If it is within the last 12 months, what's the problem?the new gas safety certificate says "Next safety check due within 12 months"

By law landlords have to keep gas safety records for a set period of time and the HSE can request to see them. Gas safety is a very important issue and I'm not sure how you could sleep at night when you has tenants in a property without an upto date gas safety certificate - what if it hadnt been just a small gas leak but a death from carbon monoxide poisoning?
The Health and Safety Executive website and the Gas Safe Register website have details on the rules for landlords and the HSE website also gives details of past prosecutions against landlords.
If you are not sure of the laws regarding letting employ a letting agent or join a trade organisation such as the National Landlords Association for advice. You could also set up a landlords contract with a company such as British Gas (or any suitable company with qualified staff) to ensure that certification etc is done at required times.0 -
Annual gas Safety checks are a legal requirement - failure to do this can result in heavy fines or even imprisonment.
Severe penalties for non-compliance can be imposed and deaths could result in manslaughter charges for landlords and agents. Non compliance is a criminal offence and courts can impose unlimited fines and custodial sentences. This may also invalidate your property insurance and could subsequently lead to claims for civil damages - awards in these cases have proved to be very high indeed.

There is a lot of noise made about gas saftey certs, and whilst I am aware of the danger, the law and moral responsibility , andwould never rent one of my properties without one. A valid GSC is not the be all and end all of gas saftey, it is merely a single snapshot of the appliances at the time of inspection, like an MOT on a car.
Years ago I lived in a house and one year the gas fire passed it's inspection, the next year inspected by the same guy it failed. Now at some point that appliance became unsafe, now it could have been anytime from a minute after it was tested the first time to a minute before it was tested the second time.
My personal opinion is that there should be more legislation with regards to detection of gas and carbon monoxide, not more reliance upon gas saftey certification0 -

True. Best have leglislation to enforce daily inspections.

You make a valid point Chappers but as things stand at the moment, if a gas appliance/pipework in a LL's property develop a leak and he can't even show that he's kept up with the minimum legal requirement to have a current gas safety cert ( & retain his old ones for 2 years) then he's a fool and a danger to his tenants.
I don't fully understand what the OP is saying about his/her own situation so its difficult to comment further.0 -
It seems to me the OP is simply terrified about what may arise from being reported to the HSE.
Perhaps the reference to the cooker installation and CM detector is to show that he is not completely negligent in his responsibilities. Maybe that will be hold some sway in his defence to any investigation/prosecution.Opinion, advice and information are different things. Don't be surprised if you receive all 3 in response.

I totaly agree, my point is more about the false sense of security that a valid GSC lures both tenants and LLs into.0
