Tring to sell

Hi
Im after some advice I am tring to sell my house I have a buyer but the solicitors have requested planning permission for the conservatrey but I dont have any (it was a self build from b and Q)
Is there anything I can do ?

    Look up planning regulations. Google on 'Permitted development' [I think] - a conservatory may not need planning permission.

    Did you check with your Council Planning Dept when you built it? If not, check now. As DV says, in most cases a conservatory does not need PP.

  • If you're after an indemnity insurance policy then don't tell the council about the conservatory, otherwise you won't be able to get one.

    However, when was the conservatory built? If it's more than 4 years ago, you have nothing to worry about and just tell the buyers solicitors it is immune from planning enforcement action (assuming it ever need permission in the first place!). It's also far simpler and cheaper to check to see if it needed permission - the links to permitted development above will not be applicable if it was built before 1 Oct 2008 though, as permitted development was different then.

    They wouldn't, but would any development be retrospectively enforced after regs are changed ? I doubt it.

    The link to this info is still worth following! If it is OK under the definition of permitted development after 1 Oct 2008, but was not OK before that, what are the council going to do? Insist it is knocked down and allow you to rebuild an identical conservatory and wait for the stupid bureaucrats story in the paper?

    I know you may not want to tell the council due to the indemnity insurance and difficulty getting it if you have told the council, but my wife had the same issue when selling her house and although it didn't need planning permission the buyers insisted on something official to confirm that. The council popped round for ten minutes and then confirmed in writing that it was ok. Might be worth considering.
    I'm proud of my advice, if others want to look I say enjoy the show!
