Laid off from Tesco because they made a mistake

Hope someone can give me some advice, My 18yr old daughter was laid off from Tesco, the reason she was given was because someone had made a mistake on the Double Points promotion (not my daughter) and they had to lay off 12 staff to reclaim lost profits. She has worked there for just under a year on a part time temporary contract,she has recently had time off with swine flu. while she has been laid off there are other workers on temporary contracts who have only been there a couple of months, should they have gone first? Are they allowed to just sack staff because management have messed up? They have also asked her if she can work next week (after telling her she was sacked),Does she have to work?or should she tell them where to stick it.

  • She has worked for the company for under a year so she has little employments rights, so they can get rid of her.

    Has she been dismissed for gross misconduct or due to a reorganisation/ lack of work/ redundancy? If the latter, she would be expected to work any notice period, in the same way that she would if she had resigned.
    Gone ... or have I?

    alwaysonthego is correct as usual.

    As she was there less than year they can get rid of her for no reason (or not tell her) as long as its not discriminatory (ie gender, age etc), which does not apply here.

    Not uncommon practice.

    Keep part time staff for up to a year then get shut, then re-hire.

    They get to avoid all the employee rights issues this way.

    Depending on the contract, will depend if she needs to work any notice.
    Wether she goes to work again next week at their request is up to her.
    A job can be hard to find at the moment - even if just for another week.

    I got laid off from Tescos due to "falling sales caused by a new Sainsburys" (two miles away!!!). Again, there were other temp workers who'd been there a couple of months, when I'd been there 8.

    I really think its 'cause i said that i didn't *think* it was right that asylum seekers could use their food vouchers to buy fags and booze.

    A week later, i went in to hand back my uniform, and saw my job (nearly the same shifts) advertised on the wall!!! Asked for my job back, and got it.

    Asylum seekers were taking all their tesco vouchers to local brothels :)
