stopping nasty phone calls from creditors

    hiya would it be possible if i could ask you a quick question about Baliffs? as you seem to have a really good knowledge on this area sorry to bother u by PM but its the first time ive seen u on in ages

    well basically my brother is up to his eyeballs in debt (between £30-50,000 in debt) and lives with my mother hes already had a baliff come round once and i went round and paid the baliff because he started to threaten to start taking stuff of my mums

    Now my brother doesnt have any assests he doesnt even own anything in his room apart from his clothes. Can the Bailiff take any think of my mums or my other brothers? i.e. computer, TV, Laptop, etc. Cos this one seemed to think he could just cos my brother lived in the house and the possesions where in what he called a communal area of the house.

    would just like to know what the standing is on this?

  • If your mother states that the property is her's he cannot touch them. If she states the property is her's then he cannot take anything, if he does, your mother can get him for theft, he will also need a warrant to enter the property unless you invited him in. Don't ever invite him unless he shows a warrant.

    Best thing your brother can do is file for bankruptcy, he just needs to cough up the initial fee and that's him clear. Might also be a wake up call for him, this is a LOT of money to be in debt with. Tell him to check up on going bankrupt, if he has no assets then it's best he does, without a doubt.

    Many thanks :beer: my mum is moving in the next couple of weeks and as soon as they have moved into the new house then my brother will be filing for bankruptcy. My mum invited the bailiff in cos he had a warrant my other brother had the savvy to start moving stuff out of the house and my mum called the police cos my brother was kicking off. The Bailiff turned round to my other brother and said that he could have him arrested for moving his and my mums items out of the house which i thought was a bit of a cheek considering they own them.

  • Hello this thread has answered some of my worries but just a couple of others. If some of your credit has gone to debt collectors does that mean you will get baliffs or will they take your offer? I have sent letters with my budget plan should i just wait for replies to arrive or should i follow it up with a phone call? My biggest concern is someone turns up on my doorstep!

    A painless way for you to stop phone calls is to tell your telephone provider that you are getting nuisance calls and you would like a new number. I did it, it took about a week and then no more calls.

    It must have frustrated the callers as the number would have come up not in use!!!

    A small triumph but I got quite petty about any small victory.

    Please can somone post the legal times a company can call a customer.

    This weekend Saturday 820 am and Sunday 818am Barclays telephoned me on the landline unexpectedly.

  • legaly if you are "opted in" for maketing call you can be called 9am -9pm monaday to saturday.

    FSA regualtions state the the finacial organistion must keep this data up to date .
    Debit was £64k (light bulb Feb 05)
    Debt now 60K Dec 07 DFD= nov2019 :confused:
